Resolution No. 5644 Approving the Abandonment of a Temporary Drainage Easement No Longer Needed for Public Use on the Southeast Corner of Chandler Heights Road and 124th Street
Proposed Motion:
Move City Council pass and adopt Resolution No. 5644 approving the abandonment of a temporary drainage easement no longer needed for public use, located on the southeast corner of Chandler Heights Road and 124th Street.
Background:
In 2020, the City acquired a temporary drainage easement (the "TDE") for the Chandler Heights Road Improvement Project from McQueen Road to Gilbert Road (ST1614), located on the southeast corner of Chandler Heights Road and 124th Street (the "Property"), from the then-owner of the property, Laramie Land & Holdings, LLC. Since the date of the City's acquisition, the Property has been sold to Keystone at Hazelwood, LLC, a Delaware limited liability company (the "Owner"), which is in process of engineering and subdividing the land under the name of Hazelwood. The Owner requires a revised drainage easement to conform to its development plans. In exchange for the City agreeing to abandon the TDE, the Owner will dedicate a new permanent drainage easement to the City.
Staff reviewed the request and concurs that the TDE may be abandoned after the City's acceptance and recordation of a new permanent drainage easement that will accept drainage volume that the TDE was designed to accept for the Chandler Heights Improvement Project.
