Review and Recommendation: |
This request is to allow outdoor live entertainment. Ghett Yo Taco has been operating at this location for over four years. The Entertainment Use Permit Request for live outdoor entertainment is to enhance the restaurant patrons' experience. The outdoor entertainment will consist of soloists, DJ's, bands and dancing. Live entertainment hours will follow standard business hours. Standard business hours are Sunday to Thursday 10am to 12am and 10am to 2am on Friday and Saturday. Live entertainment will end at 10pm Sunday to Thursday and at 11pm Friday to Saturday. The applicant is willing to address concerns of residents as they arise as demonstrated at the neighborhood meeting, when a resident had a concern about the noise levels. Additionally, a liaison has been designated, whose name and number will be made available to neighbors for them to contact the applicant about any noise related concerns. Staff is recommending approval subject to a one-year time stipulation, given the proximity to residential. |

This request was noticed in accordance with the requirements of the Chandler Zoning Code.
- A neighborhood meeting sign was posted on the site and on social media via NextDoor.
- A neighborhood meeting was held on May 1, 2023. One resident was in attendance who had concerns about noise levels, specifically drums. The applicant spoke with the resident and his concerns had been addressed.
- As of the writing of this memo, Planning staff is not aware of any opposition to the request.

Recommended Conditions of Approval |
Planning staff recommends Planning and Zoning Commission move to recommend approval of the Use Permit, subject to the following conditions:
- Substantial expansion or modification beyond the approved exhibits (Site Plan, Floor Plan and Narrative) shall void the Use Permit and require new Use permit application and approval.
- The Entertainment Use Permit is non-transferable to any other location.
- The site shall be maintained in a clean and orderly manner.
- Music shall be controlled so as to not unreasonably disturb area residents.
- The establishment shall provide a contact phone number for a responsible person (i.e. bar owner and/or manager) to any interested neighbors or property owners to resolve noise complaints quickly and directly.
- The Entertainment Use Permit shall remain in effect for one (1) year from the date of City Council approval. Continuation of the Use Permit beyond the expiration date shall require re-application to and approval by the City of Chandler.
