Resolution No. 5539, Authorizing the City of Chandler to Enter into an Agreement to Share Costs for the Feasibility Study of Bartlett Dam Modification Alternatives and Repealing Resolution No. 5533 Authorizing a Previous Version of the Agreement
Proposed Motion:
Move City Council approve Resolution No. 5539 authorizing the City of Chandler to enter into an agreement to share costs for the Feasibility Study of Bartlett Dam Modification Alternatives Among Various Participating Entities and Salt River Agricultural Improvement and Power District in the amount not to exceed $400,000, and repealing Resolution No. 5533 authorizing a previous version of the agreement.
Background:
The United States Department of the Interior’s Bureau of Reclamation (BOR), in partnership with the Salt River Project (SRP), is initiating a Bartlett Dam Modification Feasibility Study to evaluate alternatives to mitigate lost storage due to sedimentation within the Horseshoe Reservoir. Alternatives evaluated include increasing the height of Bartlett Dam. Proposed Bartlett Dam modifications may benefit Chandler and other entities by improving management of the water supplies of the Verde River, improving the ability to manage shortages created by drought conditions, and creating New Conservation Storage capacity to provide additional water supplies for lands outside the SRP service area. The feasibility study will require funding from both federal and non-federal sources.
On December 9, 2021, City Council approved Resolution No. 5533, authorizing the City to enter the agreement to share costs for the feasibility study. The agreement authorizes an annual contribution of $100,000, not to exceed $400,000, over the four-year period to participate in the Non-Federal Cost Share portion of the feasibility study. This contribution level allows Chandler to be a voting member on the Feasibility Steering Committee. This project could restore water supplies within Chandler’s SRP service area lost to Horseshoe Reservoir sedimentation and provide additional water supplies generated by New Conservation Storage capacity to meet Chandler water demands outside SRP’s service area.
On December 10, 2021, SRP notified the City of a change to Subparagraph 13.2 of the agreement that clarifies that no aspect of the agreement constitutes a waiver of sovereign immunity by the Fort McDowell Yavapai Nation. It is therefore necessary to repeal Resolution No. 5533 and adopt a new resolution authorizing the revised agreement as modified by SRP on December 10, 2021. Staff is requesting City Council approve Resolution No. 5539, which repeals Resolution No. 5533 and authorizes the revised agreement to share costs for the Feasibility Study of Bartlett Dam Modification Alternatives.
