Resolution No. 5764 Authorizing the Acquisition of Real Property for the Price Road Frontage Sewer Rehab Project

Proposed Motion:

Move City Council pass and adopt Resolution No. 5764 authorizing the acquisition of real property in fee and easement as required for the Price Road Frontage Sewer Rehab Project (WW2210), from two parcels described in Exhibits “A” and "B"; authorizing the city’s real estate administrator to sign, on behalf of the city, the purchase agreement and any other documents necessary to facilitate the acquisition; and authorizing relocation assistance as may be required by law.

Background:

The city is rehabilitating sanitary sewer and manholes along the Price Road Frontage Road between Elliot and Frye roads. To perform some of the rehabilitations, it will be necessary to obtain real property either in fee or by easements or access agreements, as needed, from two property owners. This property is required to perform the rehabilitation work, as some of the city's assets are currently not located in right-of-way or an easement.

When the sewer infrastructure was relocated as part of the Loop 101 Price Freeway construction, the final construction location was outside the easements. Since these are established properties, some relocation of personal property or improvements may be required, which will be compensated as required by law. It is not anticipated that any businesses, residential property owners, or tenants will be relocated. The real property rights to be acquired by fee or easement will be appraised, as required, and offers of compensation will be made pursuant to the appraised values. Values for access agreements will be negotiated on a case-by-case basis. In the event relocation services are required, the city will provide those services as required by law.

Financial Implications:

Funds have been set aside in the project for acquisition and relocation services.
