Subject:

Resolution No. 5969, SRP Land Use License for Underground Waterline Access, McQueen and Queen Creek Roads

Proposed Motion:

Move City Council pass and adopt Resolution No. 5969 accepting a Land Use License from SRP to Provide Access to its property to operate and maintain a turnout structure serving the city’s Reclaimed Water Interconnect Facility (RWIF) located on the west side of McQueen Road, south of Queen Creek Road.

Background:

SRP currently operates and maintains a turnout structure adjacent to the Airport Water Reclamation Facility (AWRF), located at 905 E. Queen Creek Road. The turnout structure conveys raw surface water from the SRP Consolidated Canal to the RWIF on the AWRF site, where it is used to supplement current reclaimed water supplies. The intake structure consists of a pre-cast concrete structure with a trash rack and a manual hydraulic gate to control flow. Under the proposed license agreement, operations and maintenance of this structure will be transferred to the City of Chandler, granting the city authority to make modifications and improvements as needed. The license grants the city access to the facility over SRP land.

Financial Implications:

SRP has the right to bill the city for all federal, state and local excise, sales privilege, gross receipts, and other taxes lawfully imposed on and paid by SRP with respect to the licensed property (Section 4 of Land Use License).
