Proposed Motion:

Move City Council introduce and tentatively adopt Ordinance No. 5159, amending the Code of the City of Chandler, Chapter 11, by adding Section 11-20, Drink or Food Tampering.

Background/Discussion

Based on an initiative by Councilmember Harris, Ordinance No. 5159 amending the Code of the City of Chandler, Chapter 11 to prohibit tampering with a person's drink or food is presented for Council action. This Ordinance, if approved, would prohibit a person from knowingly introducing any intoxicating liquor or drug into another person's food or drink without the knowledge or consent of that person. In Arizona. Violations of this Code amendment shall be a class one misdemeanor punishable by up to a $2,500 fine, 6 months incarceration and/or 3 years probation. Arizona Revised Statutes have classified this offense as a class 6 felony. Approval of Ordinance No. 5159 would allow prosecution of an individual who tampers with someone's food or drink in Chandler Municipal Court if the case were not charged as a felony by the County Attorney's Office.
