Resolution No. 5549 Approving the Acquisition of Real Property Needed for the Chandler Heights Road Utility Relocations and Salt River Project 230kv Power Line Easement
Proposed Motion:
Move City Council approve Resolution No. 5549 determining that acquisition of real property needed for the Chandler Heights Road utility relocations and Salt River Project 230 kilovolt power line easement in the vicinity of Chandler Heights Road from the Union Pacific Railroad alignment to Dobson Road is a matter of public necessity; approving the purchase of such real property at market value plus closing and escrow fees; authorizing the City’s Real Estate Manager to sign, on behalf of the City, the purchase agreements and any other documents necessary to facilitate these acquisitions; approving eminent domain proceedings as needed to acquire said real property and obtain immediate possession thereof; and approving relocation services as may be needed and required by law.
Background:
On June 24, 2021, City Council approved Resolution No. 5496, authorizing the City to enter into an agreement with Salt River Project (SRP) to provide a 35-foot wide easement within the Chandler Heights Road alignment from just east of the Union Pacific Railroad to Alma School Road, then north along Alma School Road, and then west on Lake Drive and Chaparral Way to Dobson Road. The easement will facilitate a new 230kV power line to provide additional service to Intel Corporation. The City is required to relocate some of its existing utilities to accommodate the project. The City does not own all of the underlying fee interest in the roadways along this route. In some areas, the City only has roadway easements; the City cannot grant an easement to SRP within these easement areas. For this reason, it is necessary to acquire property rights in fee along the proposed route of the project. The City may also need to acquire temporary easements required to construct the project.
Financial Implications:
Funds for the acquisition of right-of-way will come from funds that are budgeted for the project. Amounts will be determined by appraisals for each parcel.
