Review and Recommendation: |
On September 23, 2021, SanTan Brewing received an Entertainment Use Permit subject to conditions. Condition #1 stipulated that "Substantial expansion or modification beyond the approved exhibits (Site Plan, Floor Plan, Narrative) shall void the Use Permit and require new Use Permit application and approval." The applicant is proposing to move the stage, as proposed on the previous plans, to a location that increases the entertainment area. An exhibit showing previous approval as well as previous stipulations is attached within this memo. As such, the request to expand patio square footage by moving the stage and thus adding to the entertainment boundary necessitates a new Entertainment Use Permit approval. Further, the applicant has requested to remove a stipulation previously which limits the type of entertainment to acoustic with no drums, also necessitating a new Entertainment Use Permit approval. The primary use of SanTan Brewing is an industrial brewery with an ancillary tasting room. The tasting room, which consists of both indoor and outdoor (patio) space, functions primarily as a beer tasting space for those who tour the facility, though the tasting room is open to the general public. Live entertainment is proposed between the hours of 3 pm and 9 pm, Monday through Thursday, between the hours of 11 am and 10 pm on Saturday, and between the hours of 11 am and 9 pm on Sunday. Notably, this request differs from the previous approval, as there is an increase in the intensity of entertainment (removal of stipulation stating no amplification or drums). This request can be supported due to there being no noise complaints in the past year, even though SanTan often hosts concerts featuring amplification and drums under special event permits.Other than removing the stipulation regarding amplification and drums, all conditions are remaining consistent with the previous approval. A three-year time condition is being proposed to evaluate compatibility with surrounding land uses. Considering the limited hours of entertainment, Planning staff has reviewed this request and find it is consistent with the General Plan and recommends approval with the same stipulations, except that of the limitation on drums and amplified music. The Preliminary Development Plan is being requested due to proposed shade structures and a small covered stage that project into the minimum building setback. The proposed setback encroachment is limited to shade structures attached to the building, shade sails, and a single stage that encroaches into the setback. The proposed shade sails are approximately 16' away from the property line and the stage cover is at 6'. The proposed shade sails have a limited massing profile while maintaining a consistent architectural theme. Staff finds that the proposed setback reduction is reasonable and consistent with the zoning and General Plan; Planning and Zoning Commission recommends approval. |

Recommended Conditions of Approval |
Preliminary Development Plan Planning and Zoning Commission recommends the City Council approve the Preliminary Development Plan, subject to the following conditions:
- Development of the overall site shall be in substantial conformance with the exhibits kept on file in the City of Chandler Planning Division, in File No. PLH21-0073, modified by such conditions included at the time the exhibits were approved by the Chandler City Council and/or as thereafter amended, modified or supplemented by Chandler City Council.
- Preliminary Development Plan approval does not constitute Final Development Plan approval; compliance with the details required by all applicable codes and conditions of the City of Chandler and this Preliminary Development Plan shall apply.
Entertainment Use Permit Planning and Zoning Commission recommends City Council approve the Entertainment Use Permit, subject to the following conditions:
- Substantial expansion or modification beyond the approved exhibits (Site Plan, Floor Plan and Narrative) shall void the Entertainment Use Permit and require new Entertainment Use Permit application and approval.
- The site shall be maintained in a clean and orderly manner.
- The hours of live entertainment shall be limited to 3pm to 9pm Monday through Thursday, between 11am and 10pm on Saturday, and between the hours of 11am and 9pm on Sunday.
- No noise shall be emitted from external speakers in such a manner that exceeds the general level of noise emitted by uses outside the premises of the business and disturbs adjacent businesses and residential areas.
- The establishment shall provide a contact phone number for a responsible person (i.e., brewery owner and/or manager) to any interested neighbors and property owners to resolve noise complaints quickly and directly.
- The Entertainment Use Permit shall remain in effect for three (3) year from the date of City Council approval. Continuation of the Entertainment Use Permit beyond the expiration date shall require re-application to and approval by the City of Chandler.
