Resolution No. 5621 Approving the Abandonment of Two Temporary Drainage Easements
Proposed Motion:
Move City Council pass and adopt Resolution No. 5621 approving the abandonment of two temporary drainage easements no longer needed for public use on the south side of Germann Road and east of Cooper Road between the Wright Drive alignment and Stearman Drive.
Background:
In 2006, the City acquired two temporary drainage easements (the “Easements”), located on the south side of Germann Road and east of Cooper Road between Wright and Stearman drives (the “Property”), for the realignment of Germann Road. The current owner, Chandler Connection, LLC (the “Owner”), submitted a plat and development plans for the improvement of the Property. Construction of the improvements is currently underway. The Owner has requested the abandonment of the Easements to clear up the title to their Property and because permanent drainage facilities will be installed as part of the development plans approved by the City.
Staff reviewed the request and concurs that the easements are no longer required for public use and may be abandoned.
