Resolution No. 5625 Approving the Abandonment of a Temporary Drainage Easement
Proposed Motion:
Move City Council pass and adopt Resolution No. 5625 approving the abandonment of a temporary drainage easement no longer needed for public use on the south side of Chandler Heights Road between Salt Cedar Street and 130th Street.
Background:
In 2020, the City acquired a temporary drainage easement (the “TDE”) for the Chandler Heights Road Improvement Project, from McQueen Road to Gilbert Road (Project No. ST1614), from the owner of the property located on the south side of Chandler Heights Road between Salt Cedar and 130th streets (the “Property”). Since the date of the City’s acquisition, the Property has been sold to Cachet Homes, which is in process of engineering and subdividing the land under the name of McKinley Glenn. Cachet Homes’ development plans require shifting the TDE to the east from its current location. In exchange for the City agreeing to the relocation of the TDE, Cachet Homes will dedicate a new permanent drainage easement to the City.
Staff reviewed the request and concurs that the TDE may be abandoned after the City’s acceptance and recordation of a new permanent drainage easement that will accept the drainage volume the TDE was designed to accept for the Chandler Heights Improvement Project from McQueen Road to Gilbert Road.
