| Background/Discussion: |
On March 21, 2022, City Council approved Professional Services Agreement No. ST1614.451, with Ritoch-Powell & Associates Consulting Engineers, Inc., to provide construction oversight for the widening of Chandler Heights Road to two through lanes each in the eastbound and westbound directions from McQueen to Gilbert roads. The project also included bike lanes, raised landscape medians, curb, gutter, sidewalk, American with Disabilities Act upgrades, traffic signal upgrades, streetlights, traffic signal interconnect, storm drainage, irrigation, block walls, and wet and dry utilities. Amendment No. 1 extended the contract time by 225 days at no additional cost to the city to cover construction oversight for pre-construction services and procurement. Amendment No. 2 extended the contract time by 194 days at no additional cost to the City for construction oversight on the project. Amendment No. 3 extended the contract time by 30 days and added $90,782.56 to the agreement for construction oversight on the project. This Amendment No. 4 is for construction administration, construction inspection, and Federal Highway Administration funding oversight and compliance. The construction contract has been extended due to materials issues, and the current schedule shows the completion date to be November 8, 2024. Construction management is required to provide full oversight over the project to ensure compliance when receiving federal funding. An additional 120 calendar days has been added to the contract time, for a revised total of 1,169 calendar days to final completion, following Notice to Proceed. |

| The selection process was conducted through the Request for Qualifications process in accordance with city policy and procedure and state law. Staff reviewed the scope of work, billing rates, and total fees for the project and determined them to be reasonable. |
| Financial Implications: |
| This amendment is in the amount of $288,991.78, for a revised total agreement amount not to exceed $2,730,924.90. The City will be seeking reimbursement from the contractor for the costs related to this amendment through liquidated damages due to delay of project completion. |
