Resolution No. 5839, Intergovernmental Agreement with Mesa Unified School District No. 4 for Police Department Security Camera System Emergency Access
Proposed Motion:
Move City Council adopt Resolution No. 5839, approving an Intergovernmental Agreement granting the Chandler Police Department emergency access to the Mesa Unified School District No. 4 Security Camera System; and authorize the Chief of Police, as designated by the City Manager, to conduct all negotiations and to execute and submit all documents necessary in connection with such an agreement.
Background/Discussion:
The City of Chandler Police Department and Mesa Unified School District (MUSD) No. 4 desire to enter into this Agreement for the purpose of working in cooperation with one another to further the public interests served by prompt and informed emergency response services by allowing emergency access to MUSD's school security camera system. MUSD has four (4) schools physically located within the City of Chandler boundaries. In the event of an ongoing emergency on a MUSD school campus or facility located in Chandler, both MUSD and the Police Department desire to provide first responders with information available through the campus security camera system(s) in the interest of the safety of all involved. The City has had a similar arrangement with Chandler Fashion Mall (Macerich) since 2015 and Chandler Unified School District No. 80 (CUSD) since 2023 that allows the Police Department to access security cameras in the event of an emergency only.
The Police Department will only have access to any MUSD campus surveillance system(s) during and in response to an active/ongoing emergency occurring on or involving a MUSD campus, and only to the extent necessary to protect the health or safety of the student or other individuals as determined by MUSD. "Emergency" means a situation in which articulable facts indicate that a significant threat to the health or safety of a student or other individuals exists. The Police Department will not have access to any MUSD campus security camera system for any other purpose or at any other time. The Police Department will not have access to the security camera system of any campus that is not involved in the active/ongoing emergency and cannot record or share video content from MUSD security cameras without a subpoena. Likewise, security camera content transmitted to the Police Department from a MUSD facility will not be stored by the City.
MUSD campus surveillance footage is subject to the provisions and confidentiality provided under the Family Education Rights and Privacy Act (20 U.S.C. 1232g; 34 C.F.R. Part 99) ("FERPA"). The IGA was approved by the MUSD Governing Board on August 28, 2024, and shall remain in effect through June 30, 2028, unless otherwise terminated, with the option to renew for an additional five-year term.
Financial Implications:
There are no financial obligations to the City of Chandler.
