The Board of Adjustment of the City of Garland convened in regular session at 7:00 p.m. on Wednesday, March 20, 2024, in the City Council Chambers, 200 North Fifth Street, Garland, Texas, with the following members:

ITEM(S) FOR INDIVIDUAL CONSIDERATION
a.
23-MA-00013 – 3017 Bonita Dr
Maria G Marquez
, the owner of Lot 19, in the Bonita Estates, more commonly known as 3017 Bonita Dr,

is requesting permission to exceed the maximum allowed square footage of accessory buildings on the property. Section 2.58 (G) of the Garland Development Code establishes 947 square feet as the maximum total of accessory buildings allowed on the lot. A variance to allow the accessory building square footage to exceed the maximum allowed would be necessary to allow the buildings to remain on the property

Ms. Marquez is requesting permission to retain the first chicken coop that is 0’ from the rear and side property lines. Section 2.58 (J) of the Garland Development Code establishes 3 feet as the required rear and side yard setbacks. A variance to allow the first chicken coop to encroach 3’ into the required side yard setback and 3’ into the required rear yard setback would be necessary to allow the structure to remain on the property

Ms. Marques is requesting a variance to retain a second chicken coop that is 0’ to the side property line. Section 2.58 (J) of the Garland Development Code establishes 3’ as the required side yard setback. A variance to allow the second chicken coop to encroach 3’ into the required side yard setback would be necessary for the structure to remain on the property

Ms. Marquez is requesting permission to retain a large doghouse that is 0’ from the side property line. Section 2.58 (J) of the Garland Development Code establishes 3’ as the required side yard setback. A variance to allow the doghouse to encroach 3’ into the required side yard setback would be necessary to allow the structure to remain on the property.

Ms. Marquez is requesting permission to retain an 8’ tall galvanized metal panel fence on the property. Section 4.103 (A)(5) of the Garland Development Code prohibits galvanized metal panels for fences in a residential zoning district. A variance to allow the fence of galvanized metal panel material would be necessary to allow the fence to remain on the property.
Herman Thomas of 1001 Edgefield Dr, Garland was present to interpret for the property owner; Ma Guadalupe of 3017 Bonia Dr was present to speak on her own behalf.

to approve the 1500 square foot detached garage and deny the variance requests for the additional accessory structures as well as the metal fence.

b.
24-MA-00001 – 206 Hockaday Avenue
John and Paula Kusewitt, the owner of Lot 6 Block C, in the Ridgewood Park 7, more commonly known as 206 Hockaday Ave, is requesting permission to build a metal carport 1’ from the side and rear property lines. Section 2.58 (J) of the Garland Development Code establishes 3’ as the required side and rear yard setback. Section 2.59 (A)(3) of the Garland Development Code prohibits a carports of metal construction in the rear yard unless there is access from a paved alley. A variance to allow the carport to encroach 2’ into the required side and rear yard setback and a variance to allow the carport of metal material would be necessary to allow the construction.
John Kusewitt, 206 Hockaday Ave, was present to speak on his own behalf.

and seconded by
Board Member Herman Puckett
to approve the construction of a carport in the rear yard 1 foot from the side and rear property lines.

c.
24-MA-00002 – 416 S Third St
Mike Bernstein, the owner of Lot 1, in the Keller Addition, more commonly known as 416 S Third St., is requesting permission to build a 4’ Wrought Iron fence in the required front yard of the property. Section 4.104 (A) establishes that no fence can be constructed in front of a building in a nonresidential zoning district. A variance to allow the fence to be built past the front of the building would be necessary to allow the fence to be constructed.
Mike Bernstein of 3010 Marilee Dr, Garland was present to speak on his own behalf.
Motion was made by
Board Member Wesley Johnson,
and seconded by
Board Member Margaret Bice
to approve the variance as requested.
