INTERGOVERNMENTAL AGREEMENT (IGA) WITH FLOOD CONTROL DISTRICT OF MARICOPA COUNTY FOR ACQUISITION OF LAND RELATED TO THE BULLARD WASH TRAIL EXPANSION

SUMMARY
The proposed Intergovernmental Agreement (IGA ) with Flood Control District of Maricopa County (“The District”) conveys a portion of APN 500-04-982b to City of Goodyear for the continued development of the Bullard Wash Trail.
STRATEGIC PLAN ALIGNMENT
RECOMMENDATION
Approve the IGA with the Flood Control District of Maricopa County (“The District”) and providing authorization and direction to take action and execute documents necessary to carry out the intent of the agreement. (David Seid, Deputy Director, Parks and Recreation)
FISCAL IMPACT
Goodyear currently maintains the land being conveyed by the District. There is no additional fiscal impact to acquiring the property.
BACKGROUND AND PREVIOUS ACTIONS
Since 1998, the District and Goodyear have collaborated on various IGAs for maintenance and improvements along Bullard Wash. The collaborative vision between both agencies has been one of stormwater management, and the incorporation of trail development for public recreational purposes.
In 2023, City Council adopted the Parks and Recreation Master Plan. This plan identified priorities for existing park improvements as well as new facilities. The extension of the Bullard Wash Trail was identified as a top priority in the plan.
In 2023, Goodyear voters approved a $17 million bond initiative to fund additional trail improvements along Bullard Wash from McDowell Road to the Goodyear Ballpark.
STAFF ANALYSIS
The 2023 Parks and Recreation Master Plan identified the Bullard Wash Trail Extension as one of the top priorities for Goodyear residents. The plan further identified the need to acquire a section of land owned by the District between McDowell Rd and Interstate 10 to allow for contiguous connection of the trail.
The Intergovermental Agreement (IGA) included as Attachment A identifies the following responsibilities:
Goodyear shall:
Maintain water conveyance flows and the floodplain
Operation and maintenance of the Bullard Wash Channel system, including any channel improvements
Design and construction of the trail along the wash
Ensure safety for all non-flood control uses
Schedule annual inspections with the District and correct any identified deficiencies
Provide written notification to the District that the project has been properly maintained in accordance with the design intent on an annual basis
The District shall:
Lead the execution of the transfer of property
Review and comment on the design and/or construction of any future modifications
Once this IGA is executed and the land is acquired, formal design and phasing evaluations will begin.
