STIPULATIONS |
1. Any technical corrections to this final plat required by the City Engineer or his designee shall be made prior to the recordation of the Final Plat of
Silva Trails at West Goodyear Phase II
(the “Final Plat”); and 2. Prior to recordation of the Final Plat, Owner shall submit an updated title report for the property included within the Final Plat (the “Property”) and shall modify this plat to reflect the current ownership and current lender including on the final plat a Lender Consent and Subordination in a form approved by the City Attorney or his/her designee for all lenders with a security interest in the property being platted herein. Owner shall provide documentation acceptable to the City Attorney or his/her designee demonstrating that the party executing this final plat is authorized to do so; and 3. The annexation of the portion of the Property located within the jurisdiction of Maricopa County, which is generally the portion of the Property located within the Citrus Road Alignment from W. Van Street to W. Harrison Street, shall be completed prior to the recordation of the final plat. Prior to recordation of the final plat, the east ½ street annexation of Citrus Road, from W. Van Buren Street to W. Harrison Street, shall be completed; and 4. Owner shall, at no cost to the city, design and construct street improvements for the east-half of the section of Citrus Road adjacent to the frontage of the Property required for full half street improvements for a Minor Arterial as set forth in the Engineering Design Standards in effect when the improvements are constructed, except for the construction of ½ the median and ½ median landscaping, including, but not limited to, pavement, curb and gutter, sidewalks, street frontage landscape and landscape irrigation, and street lighting (the “Citrus Road Improvements”). The Citrus Road Improvements shall be shall be substantially completed, as determined by the City Engineer or his designee, prior to the issuance of any building permit for any structure, except for model homes and shall be completed and accepted by the City Engineer or his designee, subject to completion of the two-year warranty period, prior to the issuance of any Certificate of Completion, Temporary Certificate of Completion or Certificate of Completion for any structure within the Property except for model homes; 5. Owner shall remit to the City an in-lieu payment for one-half the cost of a full median and one-half the cost of full-median landscaping for the median that is to be installed within the section of N. Citrus Road along or adjacent to the frontage of the Property. The in-lieu payment for the median shall be based on the actual costs of the improvements if constructed or if not constructed, the estimated cost of the full median and full median landscaping as determined by the City Engineer or designee, and it shall be paid prior to the recordation of the first final plat subdividing all or part of the Property; and; 6. All of the infrastructure improvements permitted by City of Goodyear Permit #21-3958 shall be completed and accepted the City Engineer or designed, subject to completion of the two-year warranty period, prior to the issuance of any temporary Certificate of Completion, Certificate of Completion, Temporary Certificate of Occupancy, or Certificate of Occupancy for any structure within the Property except for model homes; and 7. The central park that includes all of the resident and recreational amenities identified in Ordinance 2021-1495 shall be substantially completed as determined by the Building Official or his/her designee or under construction and bonded for completion as determined by the Zoning Administrator or his/her designee prior to the issuance of any Temporary Certificate of Completion, Certificate of Completion, Temporary Certificate of Occupancy, or Certificate of Occupancy for any structure within the Property except for model homes; and 8. Unless Water Line C identified in the West Goodyear master water study Resolution of Intention No. 06-1064 as amended by Resolution No 14-1621 and Resolution No. 16-1747 (the “Cost Recovery Resolution – Water Delivery Lines”) has been fully constructed and accepted by the City Engineer or his designee subject to completion of the two-year warranty period, or is under construction by others when the final plat is recorded, Owner shall be responsible for completing the construction of regional Water Line C. No building permits for any structures within the Property shall be issued until regional Water Line C has been substantially completed as determined by the City Engineer or his designee and no certificates of completion or certificates of occupancy shall be issued for any structure within the Property until Water Line C has been fully completed and accepted by the City Engineer or his designee subject to completion of the two-year warranty period. |
FISCAL IMPACT |
Although a fiscal impact analysis has not been conducted on this specific project, all new development will have an ongoing fiscal impact on the City. The development is responsible for construction of all infrastructure necessary to serve the site and will generate one-time revenue for the City through payment of permits, construction sales tax and development impact fees. Longer term fiscal impacts include increased demands for municipal services, the costs of which may or may not be offset by increased property values/tax levies, city sales tax, state shared revenues and the increased demand for commercial and retail development. Any areas that will be maintained by the city are constructed by the developer and then conveyed to the city two years after construction. |
BACKGROUND AND PREVIOUS ACTIONS |
On February 22, 2021 the City Council adopted Ordinance No. 2021-1495 rezoning the property subject to the Ordinance to the R1-4 (Single Family Detached) Zoning District with R1-4 Reduced Development Standards with a PAD overlay. On May 24, 2021 the City Council approved the preliminary plat for Silva Trails at West Goodyear, subdividing approximately 138.81 acres into 616 lots and 57 tracts. On July 18th, 2022 City Council approved the Final Plat for Silva Trails at West Goodyear Phase I, subdividing approximately 87.35 acres into 354 lots and 38 tracts east of the southeast corner of North Citrus Road and West Van Buren Street. The Final Plat for Silva Trails at West Goodyear Phase I was recorded with the Maricopa County Records (M.C.R. 20220672770) on August 26th, 2022. |
STAFF ANALYSIS |
As set forth in the attached preliminary plat Council Action Report, the proposed subdivision is consistent with the General Plan and will not adversely impact the surrounding area. Further, the proposed subdivision is consistent with the technical requirements of the city’s subdivision regulations and engineering standards, and provides for the orderly development of the property by identifying the required infrastructure needed to serve the development. The Final Plat is in substantial conformance with the Preliminary Plat. |
