SUMMARY
Acceptance of right-of-way for roadway improvements on West Lower Buckeye at Estrella Parkway and Wood Boulevard.

RECOMMENDATION
Authorize the acceptance and execution of a Special Warranty Deed from Goodyear BP North Owner, LLC conveying right-of-way needed for roadway improvements as required by the City of Goodyear for the Revolve at Ballpark Village Development. (Kevin Spicer, Real Estate Specialist)
FISCAL IMPACT
There is no fiscal impact to the city of accepting the dedication of right-of-way needed for roadway improvements at the intersections of West Lower Buckeye at Estrella Parkway and Wood Boulevard. The construction of roadway improvements by the developer will generate one-time revenue for the city through payment of permits and construction sales tax. Upon the acceptance of the roadway improvements by the City Engineer, subject to the completion of a two-year warranty period, the City will be responsible for maintaining the right-of-way.
BACKGROUND AND PREVIOUS ACTIONS
Goodyear BP North Owner, LLC is the landowner of parcel 500-07-014J applying for development of a proposed multi-family residential project at the southeast corner of West Lower Buckeye and Estrella Parkway to be known as “Revolve at Ballpark Village” (the “Project”). The dedication of the right-of-way is required for the development of the Project. The right-of-way is the corner dedications at Lower Buckeye and Estrella Parkway and Lower Buckeye and Wood Boulevard. It is City policy that right-of-way granted to the City must be in fee ownership.
The Developer is responsible for constructing the improvements. The City will own and maintain the right-of-way.
STAFF ANALYSIS
Goodyear BP North Owner, LLC has agreed to convey the right-of-way to the city pursuant to the Special Warranty Deed attached hereto. Council approval is required to accept the conveyance of right-of-way. Staff is recommending acceptance of Special Warranty Deed granting right-of-way needed for roadway improvements that the City will own and maintain. The acceptance and execution of the Special Warranty Deed attached will facilitate the development of the Project.
