SUMMARY
The proposed ordinance adds the provision of vehicle immobilization and provides requirements for vehicle impounds.

ADOPT ORDINANCE NO. 2023-1586 AMENDING CHAPTER 13 (TRAFFIC) SECTION 13-3-19 OF GOODYEAR CITY CODE RELATED TO VEHICLE IMMOBILIZATION AND IMPOUND REQUIREMENTS; PROVIDING FOR CORRECTIONS, SEVERABILITY, PENALTIES, AND AN EFFECTIVE DATE. (Anthony Polse, Assistant City Attorney)
FISCAL IMPACT
There will be no direct fiscal impact to the city in FY 2024 or future years related to the adoption of this Ordinance and related City Code amendment.
BACKGROUND AND PREVIOUS ACTIONS
On July 7, 2014, Council adopted Ordinance No. 14-1304 amending and replacing Article 13-3 (Standing and Parking) of Goodyear City Code. The revisions addressed several parking complaints at that time and provided updated parking regulations and related penalties and fees. In addition, Article 13-3 was reorganized to allow for these additional provisions and renumbered for reference and ease of use.
Shortly after the adoption of the code revisions, staff discovered the consequences of renumbering Article 13-3 would now require the replacement of numerous City signs to reflect new Goodyear City Code Section number references, which would result in substantial time labor, and cost to the City. In addition, the renumbering of code sections also required several changes in the court’s computer system.
On September 22, 2014, staff sought to eliminate the cost of replacing numerous City signs and court processes with the adoption of Ordinance No. 14-1312, which revised Article 13-3 a second time to correct the renumbering of Article 13-3 to align with City signs already in existence. However, this September 22, 2014 revision inadvertently removed the provision text related to Vehicle Immobilization and Impound Requirements intended for Section 13-3-19. A summary of the historical amendments to Section 13-3-19 is attached to this report for your reference.
STAFF ANALYSIS
There is currently no provision in the current code that allows law enforcement to tow and impound vehicles for various offenses. The language that was originally provided for Vehicle Immobilization and Impound Regulations was inadvertently replaced and needs to be added back into Article 13-3 in order to authorize law enforcement officers to address unattended vehicles that constitute a hazard, obstruction, or impediment to the flow of traffic and to tow and impound vehicles of incapacitated drivers that are unable to provide for vehicle removal.
Staff recommends the adoption of Ordinance No. 2023-1586 amending Article 13-3 of Goodyear City Code, which will add the needed authorization for vehicle immobilization and impound back into City Code.
