APPROVAL AND AUTHORIZATION TO EXECUTE THE TERMINATION OF IRRIGATION DELIVERY SERVICE, TERMINATION OF TAIL-WATER COLLECTION AND PARTIAL RELEASE AND RESTATEMENT OF EASEMENT ASSOCIATED WITH THE ROOSEVELT IRRIGATION EASEMENT AND IRRIGATION SERVICES ON THE RECREATION CAMPUS PROPERTY

SUMMARY
The Roosevelt Irrigation District (RID) requires the City execute three documents in order to release the Roosevelt Irrigation District easement from the City's Recreation Campus property. These documents include the Termination of Irrigation Delivery Service, a Termination of Tail-Water Collection, and a Partial Release and Restatement of Easement.
Recommendation
Authorize the City Manager to execute the Termination of Irrigation Delivery Service, a Termination of Tail-Water Collection, and a Partial Release and Restatement of Easement between the City and Roosevelt Irrigation District, an Arizona municipal corporation. FISCAL IMPACT
There will be no fiscal impact to the City in the fiscal year 2022 or future years with the partial release of the easement and the associated termination documents.
BACKGROUND AND PREVIOUS ACTIONS
On May 8, 1928, the Roosevelt Irrigation District obtained an easement for the construction, maintenance and operation of canals and ditches which included the property acquired by the City located northwest of Yuma Road and Estrella Parkway. In 2014, it was determined by City staff that since the City’s property was no longer being farmed, there was no reason to retain the grandfathered water rights associated with this property and the City worked with the Arizona Department of Water Resources to retire the grandfathered water rights. The 1928 RID easement included, among other properties in the area, the portion of the City’s property where the Recreation Campus has been constructed.
STAFF ANALYSIS
City staff has been working with the RID to remove the irrigation facilities from the City’s Recreation Campus property. The facilities have been removed and/or relocated to allow for the termination of the existing easement. One of the last steps in the relocation process is to obtain a partial release and to terminate the City’s ability to utilize the RID tail-water collection system or to obtain irrigation delivery through their delivery system. The Partial Release and Restatement of Easement will remove the easement from the Recreation Campus property leaving it free and clear of this encumbrance and eliminate the RID’s rights to utilize the property for canals and ditches. In order to approve the partial release, RID requires that the City terminate its right to their delivery service and their tail-water collection facilities. These services and facilities are not of any use to the City since the property is no longer farmed and the grandfathered water rights have been extinguished.
