ACCEPTANCE OF A PUBLIC UTILITY EASEMENT ASSOCIATED WITH SOUTH SENDERO DRIVE-PHASE 2 WITHIN ESTRELLA MOUNTAIN RANCH

SUMMARY
Accept the dedication of a Public Utility and Sidewalk Easement along the north side of Sendero Drive required for the recording of the Map of Dedication for South Sendero Drive - Phase 2, which is associated with the Final Plat for Estrella Mountain Ranch Parcel 11H.
Recommendation
Authorize the acceptance of the dedication of the Public Utility and Sidewalk Easement from NNP III–EMR 3, LLC, a Delaware limited liability company. (Linda Beals, Real Estate Coordinator)
FISCAL IMPACT
There will be no fiscal impact to the city in the fiscal year 2022 or future years related to the acceptance of this easement.
BACKGROUND AND PREVIOUS ACTIONS
The Final Plat for Estrella Mountain Ranch Parcel 11H (Final Plat) and the Map of Dedication for
South Sendero Drive - Phase 2 (MOD)
, were approved at the September 13, 2021 Council meeting. Per the stipulations for the Final Plat and MOD this Public Utility and Sidewalk Easement must be recorded and the recording information for the easement inserted into the MOD.
STAFF ANALYSIS
The Public Utility and Sidewalk Easement along the north side of South Sendero Drive - Phase 2 is needed for the development the property within the Final Plat for Estrella Mountain Ranch Parcel 11H as it provides for placement of public utilities required for the development of this property and connectivity through this portion of Estrella Mountain Ranch.
