Chapter 37 of the Lubbock Code of Ordinances will create a new and updated Infrastructure Construction Ordinance. Article 37.01, Permitted Construction in Rights-of-Way, will address infrastructure construction within existing Rights-of-Way, and will balance the need of upgrading, maintaining, replacing, and installing new utilities with the disruptive impact on neighborhoods and the traveling public. The provisions in this chapter will preserve and maintain the public health, safety, welfare, and conveniences of the citizens of Lubbock while still allowing the necessary work to be performed. Article 37.02, Wireless Communication Facilities in the Public Rights-of-Way, moves Article 36.10 into this new chapter without additional changes. Some specific updates to the new Infrastructure Construction Ordinance are as follows:
• Requires contractors applying for registration to provide 3 references for similar work performed within the Right-of-Way;
• Includes resurfacing and full roadway rebuild if disturbing new roadways;
• Clarifies the responsibility of the permit holder during construction;
• Provides timeline to contractors for notifying property owners along the construction route;
• Requires contractors to adhere to a construction schedule and provides fees for violating the construction schedule;
• Clarifies backfill and compaction requirements;
• Clarifies restoration of the Right-of-Way;
• Reinforces the City of Lubbock Traffic Control requirements;
• Provides for permit fees to help offset the administrative cost to the City of Lubbock;
• Requires perpetual bond for construction in the Right-of-Way to cover the cost of restoring the Right-of-Way if a contractor fails to complete the project; and
• Implements a roadway usage fee if a contractor fails to complete the project within the allowable time.
