Resolution - Right-of-Way:
Consider a resolution authorizing the Mayor to execute a Street Use License and/or City Public Grounds Monitor Well Permit, and all related documents, by and between the City of Lubbock, and Approach Environmental, LLC.
Item Summary
This street use license will allow Approach Environmental, LLC, an environmental consulting firm, to install and maintain three new groundwater monitor wells on behalf of the Texas Commission on Environmental Quality (TCEQ). A Product Recovery Report has indicated that approximately 8.95 gallons of light non-aqueous phase liquid (LNAPL) have been recovered from existing monitoring wells MW-2, MW-3, and MW-4. LNAPL must be recovered to the maximum extent practicable, due to the leaking petroleum storage tank site.
The term of this Street Use License/Groundwater Monitor Well Permit will be for 5 years, and will be automatically extended for successive 5-year terms, not to exceed 20 years. Pursuant to the terms of the Street Use License, upon completion of the testing, the permit holder agrees to restore, at its cost and expense, the portion of the right-of-way utilized in this procedure, to a condition which is equal to its existing condition.
