Resolution - Business Development:
Consider a resolution authorizing the Mayor to execute Contract 17169, with NWP EB-5 Project, LLC, for the purchase of three parcels of land north of the alley, north of Marshall Street, between Slide Road and North Abbeville Avenue.
Item Summary
The North Point Public Improvement District (PID) was established through Resolution No. 2004-R0543, for the development and maintenance of green space that is open to the public, among other things. In 2015, the North Point PID Board voted to install a walking trail in a public area underneath a utility easement, on the east side of North Slide Road, directly north of Marshall Street. In 2016, the walking track was constructed. During design, the Board considered a project that would install a walking trail on either side of North Slide Road, connecting to the east and west, but they only moved forward with the east side at the time. The Board noted the desire to extend the walking trail to the west side as part of a future project.
The purchase of these three parcels enables the North Point PID to extend the walking trail to the west side of North Slide Road. One of the parcels is currently located within the boundary of the North Point PID, and the other two are located inside the adjacent Northwest Passage PID. Section 372.003(a) of the Local Government Code authorizes a PID to improve areas outside its boundaries as long as the improvements are a benefit to the PID. The Texas Attorney General's Office has provided further guidance on this issue, stating that the PID has the authority to construct improvements outside its boundary so long as the improvements confer a "special benefit" on the landowners in the PID.
The North Point PID voted to purchase the three parcels at their Regular Board Meeting on February 10, 2023.
Fiscal Impact
Contract 17169 for $49,995, is funded by the FY 2022-23 North Point PID Budget, as approved by the City Council.
