Ordinance 1st reading - Engineering:
Consider an ordinance amending Chapter 41, Impact Fees; adopting an updated impact fee study; updating roadway impact fee collection rates; and adding a section for annexed areas.
Item Summary
The City Council adopted Ordinance No. 2020-O0136 on October 27, 2020, that established Impact Fees for the City of Lubbock. Since the ordinance adoption, the City of Lubbock accepted large areas of land as voluntary petition annexations from various landowners, thereby changing the size and boundaries of the City of Lubbock. The change in boundaries necessitated an update to the Capital Improvements Plan and the service areas for Roadway Impact Fees. Additionally, an amendment to the Impact Fee ordinance is necessary to address any future annexations of property. In accordance with the Impact Fee ordinance, any updates to the collection rate or ordinance, shall follow the public hearing process as outlined in Texas Local Government Code Chapter 395. During the Capital Improvements Advisory Committee (CIAC) meeting on January 13, 2022, the CIAC recommended updating the Impact Fee Ordinance and the Impact Fee Study, to reflect and address the recent accepted and proposed annexations.
The City Council held a public hearing on March 22, 2022 to consider the amendment of the Capital Improvements Plan for roadways and the imposition of an impact fee. The recommended revised maximum amount of each proposed impact fee per service unit will be as follows:
Roadway Impact Fee:
Service Area A: $855 / vehicle-mile
Service Area B: $655 / vehicle-mile
Service Area C: $825 / vehicle-mile
Service Area D: $623 / vehicle-mile
Service Area E: $1,011 / vehicle-mile
Service Area F: $1,188 / vehicle-mile
Service Area G: $22 / vehicle-mile
Service Area H: $77 / vehicle-mile
The recommended collection rate of each proposed impact fee per service unit for Roadway Impact Fees will be as follows and remains the same as the adopted impact fee rate:
Service Area A, B, C, D, E, F: 50% of maximum amount for all land uses
Service Area G: $0 / vehicle-mile
Service Area H: $0 / vehicle-mile
No changes have been recommended to the water and wastewater impact fees, which have a collection rate set to $0. The CIAC and staff recommend adoption of this ordinance.
