Resolution - Water Utilities:
Consider a resolution authorizing the Mayor to execute an Interlocal Wholesale Wastewater Contract, with the Lubbock Reese Redevelopment Authority, for the continued discharge of wastewater into the City’s wastewater collection system.
Item Summary
On May 9, 2002, the City of Lubbock entered into a five-year wholesale wastewater service contract with the Lubbock Reese Redevelopment Authority (LRRA), since this political subdivision is located outside the City’s incorporated boundaries. The contract included a five-year automatic renewal clause. A contract amendment on May 11, 2007, extended the contract to ten (10) years from the original contract date. On April 26, 2012, a new 10-year wholesale wastewater service contract was executed between the City and LRRA.
In 2018, the City Council adopted a wholesale wastewater volume rate as outlined in the City’s Code of Ordinance Section 22.04.041(f):
"(f) The following wastewater volume rate shall be applicable for those federal, state or local governments, governmental agencies or governmental subdivisions that are authorized to acquire wastewater services by city ordinance and enter into contracts with the city for wholesale purchases. Solely for the purposes of wholesale customers, the wastewater volume rate shall be 1.27 times the wastewater volume rate for all other customers as set forth above. The rates prescribed herein for wholesale customers reflect the increased cost of service by the city for such customers, including without limitation, costs related to wastewater collection and treatment infrastructure and remote metering and service issues, standby wastewater capacity, and the impact of advancing the timing of wastewater projects to meet additional wastewater demands from wholesale customers."
The new contract being considered updates the terms and conditions of the expiring wholesale wastewater service contract, compliant with current City Ordinances. The contract allows the LRRA to continue discharging into the City’s wastewater collection system for an additional five (5) years. The 2018 adopted wholesale wastewater rate multiplier will be used in calculating the LRRA wastewater volume charges, unless the City Council desires to modify the ordinance to provide an exception for the LRRA.
The LRRA discharged 6.8 million gallons of wastewater into the City’s collection system in FY 2020-21. The City treated a total of 7.2 billion gallons of wastewater in FY 2020-21. The amount of wastewater that the LRRA discharged into the City’s system in FY 2020-21 represents less than 0.1% of Lubbock’s total treated wastewater.
Fiscal Impact
This contract will provide the Water/Wastewater Enterprise Fund approximately $38,000 each year in revenue.
