Resolution - City Manager:
Consider a resolution authorizing the Mayor to execute an Amendment to the Park Lease, dated April 25, 1938, regarding a forty-five acre tract of land known as Mackenzie Park, located in Lubbock County, Texas, by and between the City of Lubbock and Lubbock County, extending the term from ninety-nine years to one hundred and twenty-five years, for the maintenance and operation of Mackenzie Park by the City of Lubbock.
Item Summary
On April 25,1938, the County leased 45 acres of land to the State of Texas for the exclusive purpose of operating a public park for a term of 99 years. The Lease is attached as Exhibit A.
On April 13,1992, the Lease was assigned to the City of Lubbock with the approval of the State of Texas, acting by and through, the Texas Parks and Wildlife Department. The Assignment is attached as Exhibit B.
The City of Lubbock has maintained and operated the leased premises commonly known as Mackenzie Park, through the City's Parks and Recreation Department as part of the City's parks system. The Civic Center also operates and maintains the Moonlight Musicals Amphitheatre located within the leased premise.
The City and County desire to allow the City to continue to maintain and operate the leased premises as a public park and to make capital improvements within the leased premises beyond the original 99-year term, set to end in 2037. The Amendment to the original agreement will be changed to read "for a period of one hundred and twenty-five (125) years", extending the term of the lease through 2063.
Fiscal Impact
The operation and maintenance of Mackenzie Park and the Moonlight Musicals Amphitheatre is budgeted in the City's Annual Operating Budget.
