Ordinance 2nd Reading - City Council:
Consider Ordinance No. 2024-O0053, amending the City of Lubbock Code of Ordinances, Chapter 22, "UTILITIES", Article 22.04 "Wastewater System" of the Code of Ordinances of the City of Lubbock, Texas, in order to delineate sewer line repair and maintenance responsibilities.
Item Summary
On March 26, 2024, the City Council approved the first reading of the ordinance, by a vote of 6-1.
The City Council adopted Ordinance No. 2023-O0119 on October 10, 2023, amending Chapter 22 of the City of Lubbock Code of Ordinances. The ordinance allows licensed plumbers to work within public right-of-way to fully repair the private sewer lateral line between the house or business structure, and the City main located in the right-of-way. Under the previous ordinance adopted in 2006, licensed plumbers were not allowed to perform this work within the public right-of-way, and these repairs were performed by City of Lubbock Pipeline Maintenance Crews.
The proposed ordinance would allow only the City and its designated contractors to work on the sewer lateral in the public right-of-way, which is in line with the practice that was in place prior to October 10, 2023. Following this memo you will find a copy of the proposed ordinance, a redline outlining the changes to Chapter 22, and a chart showing the type of work completed by Pipeline Maintenance Crews by percentage.
Fiscal Impact
There are sufficient funds in the budget at this time to cover the change in policy. However, a budget amendment may be needed later in the fiscal year to continue covering material costs for sewer lateral repairs.
