Resolution - Planning:
Consider a resolution, pursuant to Chapter 42, Subchapter D, of the Texas Local Government Code, releasing the area described as Property I.D. R310468 by the Lubbock County Appraisal District, otherwise known as 3420 Woodrow Road, from the Extra-Territorial Jurisdiction (ETJ) of the City of Lubbock.
Item Summary
On September 1, 2023, Senate Bill 2038 went into effect, allowing property owners to petition the City of Lubbock to release their property from the City's ETJ. In order to be considered, the petition must be signed and notarized by more than 50% of the registered voters of the property described by the petition (as of the date of the preceding uniform election date); or a majority in value of the holders of title of land of the property described by the petition (as indicated on the tax rolls of the Lubbock County Appraisal District).
The petition submitted by Cory and Dennie Mortensen meets the requirements listed above. Additionally, if the City Council denies or takes no action on the petition, the Texas Local Government Code deems the petition automatically approved 60 days after it is filed and certified with the City of Lubbock.
