Public Hearing - Engineering:
Hold a public hearing regarding a proposed update to the Impact Fee Ordinance pursuant to City of Lubbock Ordinance 2020-O0136, Section 41.06.003, and consider an ordinance amending the City of Lubbock Code of Ordinances, Chapter 41, "IMPACT FEES," Article 41.01 to add a definition and Article 41.05 to clarify a provision for certain projects exempt from impact fees.
Item Summary
On October 27, 2020, the City Council adopted Ordinance No. 2020-O0136, that established Impact Fees for the City of Lubbock. Since the ordinance adoption, the City of Lubbock has processed many different types of new developments and the associated impact fees.
Staff has had some difficulty in applying Section 41.05.002.(c) under the Impact Fee Exemptions section of the ordinance based on the current wording. This section addresses the specific situation intended for infill development. This topic has been discussed at several Capital Improvements Advisory Committee (CIAC) meetings. During the Capital Improvements Advisory Committee (CIAC) meeting on March 27, 2024, the CIAC had extensive discussion about the intended spirit of this exemption and recommended minor changes to update the Impact Fee Ordinance to better reflect the original intention of the exemption.
The intent of Section 41.05.002.(c) was to encourage infill development/redevelopment by exempting properties that had existed previously, are not being demolished, potentially have a change of use, and have been used at one time with their original intended use. Additionally, the proposed building modification would not expand the original building footprint by more than 1,000 additional square feet. The proposed ordinance language clarifies these intentions and provides better language for Staff to be able to apply these exemptions where applicable. The CIAC unanimously recommended these minor changes and stated this recommendation in their March 2024 Semi-Annual Report presented to City Council on April 9, 2024.
