Ordinance 2nd Reading - Engineering:
Consider Ordinance No. 2026-O0052, amending Chapter 36 of the Code of Ordinances by adding “Division 2 Paving Alleys by Petition” to Article 36.08, establishing a process for the paving of unimproved alleys through a petition-initiated assessment process, and providing for placing a lien on property for unpaid assessments.
Item Summary
On April 28, 2026, the City Council approved the first reading of the ordinance. On May 12, 2026, the City Council tabled the second reading to June 9, 2026.
Many existing neighborhoods in the City of Lubbock have unpaved alleys. The proposed ordinance establishes a procedure for a citizen-initiated petition process for alley paving. If the petition succeeds, the cost of the alley paving project would be split among all property owners adjacent to the improved alley, in proportion to each property owner's alley frontage. In addition, as discussed during the May 12, 2026 meeting, per state statute, the City can recover a maximum of 90 percent of the costs of paving the alley through the assessment, leaving the remaining 10 percent to be funded by the City.
Below is a summary of the proposed ordinance outlining the process.
The petition must be for an alley that is at least one street block length and with a petition fee of $500.
The petition must be signed by at least two-thirds (2/3) of the abutting property owners.
The petition must represent at least fifty-one percent (51%) of the total linear footage of the abutting property owners.
An Engineering Feasibility Determination will be made by the City after the petition is received, and If approved by the City, all abutting property owners will be assessed a fee for the alley improvements based on their linear frontage.
The assessment will be established based on the Engineering Department's cost estimate and will be updated based on actual costs once the project has been completed.
Property owners will have the ability to pay the assessment up front or set up a payment arrangement for a period of up to 12 months.
Prior to proceeding with design and construction, a minimum of thirty percent (30%) of the total estimated project costs must be collected received by the City.
Following this memo, you will find a copy of the original ordinance adopted by the City Council on April 28th as well as an amended version of the ordinance accounting for the 90 percent recovery.
Fiscal Impact
The City will be responsible for 10 percent of the cost of paving an alley.
