Executive Session

The meeting recessed at 12:01 p.m. and reconvened in Executive Session under the provisions of Section 551, Texas Government Code. City Council reconvened in open session at 2:01 p.m., and the meeting was called to order at 2:03 p.m.

Hold an executive session in accordance with Texas Government Code, Section 551.071, with legal counsel for advice about pending or contemplated litigation or settlement agreement and on matters in which the duty of the attorney under the Texas Disciplinary Rules of Professional Conduct conflicts with Chapter 551.

Hold an executive session in accordance with the Texas Government Code, Section 551.072, to deliberate the purchase, exchange, lease, or value of real property.

Hold an executive session in accordance with Texas Government Code Section 551.074, to discuss personnel matters, regarding the duties, responsibilities, and/or appointments to the Building Board of Appeals, Canadian River Municipal Water Authority Board of Directors, Permit & License Appeal Board, and the Zoning Board of Adjustment.

Hold an executive session in accordance with Tex. Gov’t Code § 551.086 to discuss and deliberate, on the following competitive matters of Lubbock Power & Light, related to generation matters, including but not limited to generation unit and/or portfolio sale opportunities (Ty Cooke Gas Generating Facility).

The meeting was called to order at 2:03 p.m.

Citizen Comments - According to Lubbock City Council Rules, any citizen wishing to appear in-person before a regular meeting of the City Council, regarding any matter posted on the City Council Agenda below, shall complete the sign-up form provided at the meeting, no later than 2:00 p.m. on June 23, 2026. Citizen Comments provide an opportunity for citizens to make comments and express a position on agenda items.

Minutes

May 26, 2026 Regular City Council Meeting

Motion by Council Member Christy Martinez-Garcia, seconded by Council Member Tim Collins, to approve the May 26, 2026 Regular City Council Meeting minutes.

Vote: 7 - 0 Motion carried

Consent Agenda - Items considered to be routine are enacted by one motion without separate discussion. If the City Council desires to discuss an item, the item is removed from the Consent Agenda and considered separately.

Motion by Council Member Christy Martinez-Garcia, seconded by Council Member Brayden Rose, to approve items 5.1-5.18.

Budget Ordinance Amendment 2nd Reading - Finance: Ordinance No. 2026-O0071, Amendment 30, respecting the General Fund and Grant Fund in connection with accepting grant funding from the Texas Department of State Health Services, for the Texas Spay and Neuter Program Grant Fund.

Ordinance 2nd Reading - Right-of-Way: Ordinance No. 2026-O0072, and related documents, abandoning and closing a portion of right-of-way adjacent to Utica Avenue at 142nd Street, located in Section 5, Block AK, Lubbock County.

Ordinance 1st Reading - Right-of-Way: Ordinance No. 2026-O0074, and related documents, abandoning and closing a portion of an alley located in Section 17, Block B, Lubbock County, Texas, on the north side of the Marsha Sharp Freeway at 29th Street.

Ordinance 1st Reading - Right-of-Way: Ordinance No. 2026-O0075, and related documents, abandoning and closing a 0.063-acre portion of the Legacy Range Business Park, Tract "D", an addition to the City of Lubbock, Lubbock County Texas, on the south side of 116th Street, east of Indiana Avenue.

Resolution - Right-of-Way: Resolution No. 2026-R0217 authorizing the Mayor to execute a Memorandum of Agreement with DMILES, LLC, a California Limited Liability Company, for the purchase of a 0.2347-acre parcel located in Section 42, Block AK, Lubbock County, Texas (Parcel 77), located on the west side of Upland Avenue, south of 21st Street, and north of 22nd Street, to be utilized for the 2022 Street Bond Project.

Resolution - Right-of-Way: Resolution No. 2026-R0218 authorizing the Mayor to execute a Memorandum of Agreement, with United Sky Capital, L.L.C., a Texas limited liability company, for the purchase of a 0.026-acre tract of land located in Section 22, Block AK, Lubbock County, Texas (Parcel 34), located on the east side of Upland Avenue, south of 98th Street, and north of 100th Street, to be utilized for the 2024 Street Bond Project.

Resolution - Right-of-Way: Resolution No. 2026-R0219 authorizing the Mayor to execute a Memorandum of Agreement with Garland Kimbrell and Donna Capron, for the purchase of a 0.1784-acre tract and a 0.1775 acre tract of land located in Section 21, Block E-2, Lubbock County, Texas (Parcels 19 and 20), located on the south side of 114th Street, west of Akron Avenue, and east of Detroit Avenue, to be utilized for the 2022 Street Bond Project.

Resolution - Right-of-Way: Resolution No. 2026-R0220 authorizing the Mayor to execute a Street Use License Agreement, and related documents, by and between the City of Lubbock and Texland Petroleum, L.P., concerning property in Sections 5 and 6, Block A, Lubbock County Texas, along Guava Avenue, and north of Northeast Loop 289, for purposes related to underground pipeline.

Resolution - Right-of-Way: Resolution No. 2026-R0221 authorizing the Mayor to execute a Street Use License Agreement, and related documents, by and between the City of Lubbock and Texland Petroleum, L.P., to maintain a crude oil flow pipeline near the Intersection of North Avenue Q and Kent Street in Section 11, Block A and Section 1, Block D-4.

Resolution - Engineering: Resolution No. 2026-R0222 authorizing the Mayor to execute Amendment No. 4 to Professional Services Agreement, Contract 16854, by and between the City of Lubbock and Freese and Nichols, Inc., for additional construction phase services related to the West Lubbock Water System Expansion Project.

Resolution - Engineering: Resolution No. 2026-R0223 authorizing the Mayor to execute Corrected Amendment No. 1 to Professional Services Agreement, Contract 18963, and related documents, by and between the City of Lubbock and Enprotec/Hibbs & Todd, Inc., to clarify the contract duration language and extend the term by the intended length of one year, for service of Portable Generators and ATS Design for Emergencies.

Resolution - Engineering: Resolution No. 2026-R0224 authorizing the Mayor to execute Professional Services Agreement, Contract 19710, and related documents, with Hugo Reed and Associates, Inc., for the 82nd Street and Martin Luther King, Jr. Boulevard Drainage Improvements Project, to include Water Design, Utility Coordination, and Permitting, to be utilized for the 2022 Street Bond Project.

Resolution - Engineering: Resolution No. 2026-R0225 authorizing the Mayor to execute Public Works Contract 19424, and related documents, with Rink's Lease Service, Inc., for Phase 7 Waterline Change Out, to replace aging water infrastructure, in order to improve function and prevent leaks, system failures, and emergency maintenance.

Resolution - Public Works - Paved Streets: Resolution No. 2026-R0226 authorizing the Mayor to execute Contract 19601 with Roadway Asset Services, LLC, for collecting pavement performance data used to rate the condition of City streets.

Ordinance 2nd Reading - Public Works, Traffic Management: Ordinance No. 2026-O0073, amending Section 20.05.103 of the City of Lubbock Code of Ordinances, with regard to the establishment of school zones and speed limits, on Norfolk Avenue between 130th Street and 136th Street, and on 135th Street between Quaker Avenue and Memphis Avenue.

Resolution - Public Transit Services: Resolution No. 2026-R0227 authorizing the Mayor to execute Contract 19418 and related documents, with Brown Investment Group, LLC dba Western Collision, for Body Work and Accident Damage Repair for Citibus Vehicles.

Resolution - Lubbock Power & Light: Resolution No. 2026-R0228 authorizing the Mayor to execute a Purchase and Sale Agreement, with Adakon Energy, for the Ty Cooke Gas Generating Facility.

18.

Resolution - City Manager: Resolution No. 2026-R0229 authorizing the Mayor to execute Amendment No. 3 to Contract 16514, with MBE 3, LLC, for revisions to the Meadowbrook Estates payout schedule.

Regular Agenda

Ordinance Single Reading - Finance: Ordinance No. 2026-O0076, of the City of Lubbock, Texas, authorizing the issuance and sale of City of Lubbock, Texas, Tax Notes, in one or more series; levying a tax in payment thereof; and enacting other provisions relating to the subject. The Tax Notes will be utilized to fund Radio System equipment and high dollar value vehicles/equipment approved in the FY 2025-26 Budget.

Joe Jimenez, chief financial officer; and Matt Boles, managing director with RBC Capital Markets, gave a presentation and answered questions from City Council.

Motion by Mayor Pro Tem Dr. Jennifer Wilson, seconded by Council Member Tim Collins, to approve Ordinance No. 2026-O0076.

Vote: 7 - 0 Motion carried

Public Hearing - Planning (District 4): Ordinance No. 2026-O0077, for Zone Case 3554, a request of The Garrett Group at Keller Williams, for Verlene Avant, for a zone change from Low Density Single-Family District (SF-2) to Office District (OF), at 12202 Upton Avenue, located south of 122nd Street and west of Upton Avenue, on 5.1 acres of unplatted land out of Block E-2, Section 23.

Kristen Sager, director of planning, gave a presentation and answered questions from City Council.

Mayor McBrayer opened the public hearing at 2:23 p.m.

Greg Garrett, with The Garrett Group, appeared to speak in favor.

No one appeared to speak in opposition.

Motion by Council Member David Bruegel, seconded by Mayor Pro Tem Dr. Jennifer Wilson, to approve Ordinance No. 2026-O0077.

Public Hearing - Planning (District 5): Ordinance No. 2026-O0078, for Zone Case 3521-A, a request of Seventeen Services, LLC, for Milwaukee 104, LLC, for a zone change from Neighborhood Commercial District (NC) to Auto-Urban Commercial District (AC), at 6602 104th Street, located west of Milwaukee Avenue and north of 104th Street, on 15.03 acres of unplatted land out of Block AK, Section 22.

Kristen Sager, director of planning, gave a presentation and answered questions from City Council. Jarrett Atkinson, city manager, gave comments and answered questions from City Council.

Mayor McBrayer opened the public hearing at 2:29 p.m.

Tyler Gentry, with Seventeen Services, appeared to speak in favor.

Dr. Kevin Kenny appeared to speak in opposition.

Mayor McBrayer closed the public hearing at 2:32 p.m.

Motion by Council Member Tim Collins, seconded by Mayor Pro Tem Dr. Jennifer Wilson, to approve Ordinance No. 2026-O0078.

Public Hearing - Planning (District 5): Consider a request for Zone Case 3544, Part 2, a request for zone changes in City Council District 5, from Low Density Single-Family District (SF-2), Industrial Park District (IP), and Light Industrial District (LI to Auto-Urban Commercial District (AC), and Heavy Commercial District (HC), at 4517 Milwaukee Avenue, 1.06 acres of unplatted land out of Block AK, Section 37, 4525 Milwaukee Avenue, Tract A, Esplanade Addition, 5902 Spur 327, Heron Development Addition, Lot 12, 7204 Upland Avenue, 1.94 acres of unplatted land out of Block AK, Section 31, 7204 Upland Avenue R, 2.99 acres of unplatted land out of Block AK, Section 31, 7202 Upland Avenue, 1.35 acres of unplatted land out of Block AK, Section 31, and 6050 50th Street, 2.97 acres of unplatted land out of Block AK, Section 37, and consider an ordinance.

Public Hearing - Planning (District 5): Ordinance No. 2026-O0080, for Zone Case 3544, Part 3, a request for zone changes in City Council District 5, from Low Density Single-Family District (SF-2) to Heavy Commercial District (HC), at 7009 Marsha Sharp Freeway, 7.02 acres of unplatted land out of Block AK, Section 30.

This item was amended.

Public Hearing - Planning (District 6): Ordinance No. 2026-O0081, for Zone Case 2538-QQ, a request of Lubbock Telcom, Inc., for a zone change from Low Density Single-Family District (SF-2) to Heavy Commercial District (HC), at 8110 19th Street, located north of 19th Street and west of Alcove Avenue, on 1.4 acres of unplatted land out of Block D-6, Section 2.
