Resolution - Right-of-Way: Consider a resolution authorizing the Mayor to execute a Street Use License Agreement, by and between the City of Lubbock and the Texas Commission on Environmental Quality, for the right-of-way located on East Kemper Street, east of North Ash Avenue.

Item Summary

Texas Commission on Environmental Quality (TCEQ) is requesting a Street Use License for the purpose of installing between one and three monitoring wells for assessment activities in relation to a TCEQ Superfund site in the right-of-way on East Kemper Street east of North Ash Avenue.   The term of the license will be for five years, and will be automatically extended for successive five-year terms, not to exceed 20 years. Since TCEQ is a government entity and provides public benefit to the citizens of the City of Lubbock, TCEQ is granted this license at no cost. Pursuant to the terms of the Street Use License and upon completion of the testing, TCEQ agrees to restore, at its cost and expense, the portion of the right-of-way utilized in this procedure to a condition which is equal to its existing condition.
