Ordinance 2nd Reading - Planning: Consider Ordinance No. 2021-O0133, pursuant to Chapter 43 of the Texas Local Government Code, for annexation of the property located south of 34th Street and west of Upland Avenue, containing approximately 7.867 acres, out of Section 39, Block AK, Lubbock County, Texas, and commonly identified by the Lubbock Central Appraisal District Reference Number R126622.
Item Summary
On September 14, 2021, the City Council approved the first reading of the ordinance. In April 2018, the City Council finalized an annexation of approximately 1,450 acres, and also approved development agreements with many property owners under Chapter 212 of the Local Government Code, exempting the properties from annexation under certain terms. These “212 Agreements” contained several conditions for the property, including provisions for the termination of the agreement upon commencement of development activities. In the case of the subject property, the City received a preliminary plat from the property owners, showing their intent to develop the property and request termination of the agreement. This termination also constitutes a petition for voluntary annexation.
