Ordinance 2nd Reading - Engineering:
Consider Ordinance No. 2022-O0139, amending Chapter 37, Infrastructure Construction, Article 37.01 Permitted Construction in Right-of-Way; providing a penalty; providing a savings clause; and providing for publication.
Item Summary
This ordinance will modify the existing Chapter 37.01.003, Enforcement, of the City of Lubbock Ordinance, and will require the contractor to pay City-incurred costs for all the resources expended due to negligent acts, omissions, or violations of City of Lubbock Ordinances when working in the City of Lubbock Right-of-Way.
This ordinance will also modify the existing Chapter 37.01.039, Repair of Utilities, of the City of Lubbock Ordinances. The amendment will require the contractor, who is a Texas Commission on Environmental Quality (TCEQ) license holder, to register with the City of Lubbock Right-of-Way Department. This will allow the contractor to make repairs to water service lines in the right-of way, when damage occurs.
This ordinance will provide for a higher level of accountability to contractors working in the City of Lubbock Right-of-Way.
