Resolution 25-R-055 - Authorizing a Roadway Impact Fee Offset Agreement with the developer of the Heritage Oaks Subdivision (S.Williams/B.James)

BACKGROUND

The developer of the Heritage Oaks residential subdivision is proposing to realign and is required to construct Wiederstein Road from Schertz Parkway to approximately 200' short of Dietz Creek. Wiederstein Road is on the City's Roadway Impact Fee Capital Improvements Plan, and as such the City is required to provide offset/credits to the developer for this construction. The developer can utilize the offsets to reduce the amount of roadway impact fees that are paid. The amount of the offset/credit is calculated based on the number of lanes being constructed, the length of construction and the type of roadway, which impacts the amount of capacity being added. Roadway Impact fees are paid at time of issuance of building permits. As a side note, the City Council on April 1, 2025 approved Resolution 25-R-044 authorizing a reimbursement agreement with this developer to have the developer construct the 200' section from where they are required to construct it to Dietz Creek. The City will reimburse the developer for their costs to construct this approximately 200' long section and the developer will not receive roadway impact fee offsets/credits for this 200' section.

SUMMARY OF RECOMMENDED ACTION

Approval of Resolution 25-R-055 authorizing a Roadway Impact Fee Offset Agreement with the developer of the Heritage Oaks residential subdivision for constructing almost 2,000 feet of Wiederstein Road from Schertz Parkway to 200' short of Dietz Creek.

FISCAL IMPACT

The value of the offset is $373,660.00 but the City is required per State Law and City Ordinance to provide this credit in exchange for the road construction.

RECOMMENDATION

Approval of Resolution 25-R-055.
