- Authorizing a Standard Utility Agreement with the State of Texas for the relocation of utilities for the IH 35 NEX Project (B.James/K.Woodlee/E.Schulze)
BACKGROUND
Due to conflicts with the Texas Department of Transportation’s (TxDOT) proposed IH 35 NEX project, the City of Schertz must relocate existing water and sewer mains. In order to accomplish these relocations, the City needs to enter into a Standard Utility Agreement with the State of Texas. The agreement provides for the reimbursement to the City for the relocations.
The agreement includes the joint bid of water relocations including the relocation of approximately 23,000 linear feet of 12-inch water lines (including 2 crossings). Sewer relocations will be by non-joint bid. This will consist of the relocation of roughly 3,500 linear feet of 8-inch though 16-inch sewer mains (both gravity and pressure). The non-joint bid portion of the project also requires newly acquired easements adjacent to the interstate.
The utility relocations and easements are also fully reimbursable since this is an interstate project. Responsibilities of the City and TxDOT related to this relocation are outlined in a Standard Utility Agreement (SUA) funding reimbursement. Project expenses include the following.

Halff Associates, Inc has been hired to perform the design and easement acquisition services for the project. This was approved by Resolution 23-R-106.
GOAL
The goal of Resolution 25-R-024 is to authorize a SUA with the State of Texas for the relocation of utilities due to TXDOT’s IH 35 NEX project.
COMMUNITY BENEFIT
The relocation of utilities will allow for the continuation of water and sewer service to residents and businesses along the IH 35 corridor.
SUMMARY OF RECOMMENDED ACTION
Staff recommends that City Council approve Resolution 25-R-024, authorizing a SUA with the State of Texas for the relocation of utilities along IH 35.
FISCAL IMPACT
Initial funding for the design work has been allocated from the City’s Water and Sewer Construction Reserves as outlined in Resolution 23-R-106. Funding for the easement acquisition and construction of the utility relocations will be from Water and Sewer Construction Reserves. The total project is expected to cost $10.8 million. Approximately $7 million will be included as part of the joint bid construction contract. $3.8 million will be the non-joint bid construction costs, professional services and easement acquisition. This will be initially funded by the City and reimbursable from the State of Texas due to this being an interstate highway.
