Resolution 25-R-049 - Authorizing easement acquisition agreements related to the utility relocations for the IH 35 NEX Project (B.James/K.Woodlee/E.Schulze)

BACKGROUND

Due to conflicts with the Texas Department of Transportation’s (TxDOT) proposed IH 35 NEX project, the City of Schertz must relocate existing water and sewer mains. The City currently has sewer mains located within easement that are now being encroached on by the interstate highways new right-of-way limits. Five (5) parcels have been identified where new easements are necessary to support the utility relocations.

Halff Associates has acquired appraisals and began negotiating with property owners. The total combined cost of the easements is estimated at $110,000. No individual easement value exceeds $50,000.

As is typical with utility relocations along interstate facilities necessitated by TxDOT improvements, the cost is fully reimbursable. Responsibilities of the City and TxDOT related to this relocation are outlined in a Standard Utility Agreement (SUA) funding reimbursement.

GOAL

The goal of Resolution 25-R-049 is to authorize the City Manager to execute easement documents once negotiations with property owners are complete.

COMMUNITY BENEFIT

The relocation of utilities will allow for the continuation of water and sewer service to residents and businesses along the IH 35 corridor.

SUMMARY OF RECOMMENDED ACTION

Staff recommends that City Council approve Resolution 25-R-049, authorizing the City Manager to execute easement documents for utility relocations for the IH 35 NEX project.

FISCAL IMPACT

The initial funding for the easement acquisition will be from Water and Sewer Construction Reserves and will be later reimbursed from the State of Texas due to this being an interstate highway.

RECOMMENDATION

Approve Resolution 25-R-049.
