Resolution - Police:Consider a resolution authorizing the Mayor to execute a Memorandum of Understanding between the Bureau of Alcohol, Tobacco, Firearms and Explosives (ATF) and the City of Lubbock, on behalf of the Lubbock Police Department, as it relates to the Lubbock Regional ATF Task Force.
Item Summary
The purpose of this Memorandum of Understanding (MOU) is to investigate firearms trafficking, investigate firearms related violent crime, gather and report intelligence data relating to trafficking in firearms, conduct undercover operations where appropriate, and engage in other traditional methods of investigation, in order for the Task Force's activities to result in effective prosecution before the courts of the United States and the State of Texas.
In accordance with the Bureau of Alcohol, Tobacco, Firearms and Explosives (ATF) Order 3020.4, dated June 2, 2022, and incorporated herein, Body-Worn Cameras (BWCs) may be worn by Task Force Officers (TFOs) operating on a Federal Task Force when their parent agency mandates their use by personnel assigned to the task force. In such cases, the TFOs and parent agency must comply with all Department of Justice (DOJ) and ATF policies, and the required procedures, documentation, and reporting, while participating in the Task Force. Additionally, TFOs must comply with the Task Force Officers Body-Worn Cameras Memorandum of Understanding Addendum, included and incorporated herein as Appendix A.
Fiscal Impact
LPD will remain responsible for the salary and benefits including overtime of the officers assigned to ATF as TFOs. ATF will, subject to available funds, reimburse the Lubbock Police Department (LPD) for overtime payments made to its officers assigned as TFOs, up to $20,707.50.
