LEGAL DESCRIPTION:
The SW¼ of the NW¼ of Section 32, T15N, R19E, I.B.&M., in the City of Muskogee, Muskogee County, State of Oklahoma, less the North 330.00 feet thereof, and less the following described tract of land; Beginning at the Southwest corner of the NW¼ of said Section 32, thence N1^43'34"W along the West line thereof a distance of 440.01 feet; thence N88^36'15"E a distance of 645.01 feet; thence S1^43'34"E a distance of 80.00 feet; thence N88^36'15"E a distance of 180.00 feet; thence S1^43'34"E a distance of 360.01 feet to a point on the North line of Country Club Plaza II-B Addition; thence S88^36'15"W along said South line also being the South line of the NW¼ of Section 32 a distance of 825.01 feet to the Point of Beginning.
BACKGROUND:
The application was submitted on behalf of the property owners, and indicates the property is being platted into eighty-eight (88) lots on 22.2 acres, allowing the owners to develop and complete Phase II of the Walnut Creek Subdivision. The property is currently zoned "PUD" Planned Unit Development per approved Ordinance 4086-A. The approval of the preliminary plat will allow for the preparation of the final plat for Walnut Creek Phase II.
The Subdivision Review Committee met on February 6, 2024 at 10:30 A.M. The Engineer, Greg Armstrong, represented Colony Homes at the meeting in their absence. Public Works and the Water Department raised concerns about sewer access being in the rear of the properties. In the final, the sewer access will be moved to the front. Additionally, a conversation was had about sidewalks.
Chapter 70-83(4) Subdivision regulations specifically states: "Sidewalks will be required on both sides of any type "A" public or private street improvement that is contained within the subdivision. Sidewalks must meet all ADA requirements. Sidewalks shall be constructed in accordance with applicable standard specifications of the city. Sidewalks shall be five feet in width in residential areas. Sidewalks shall generally be located adjacent to the curb of the street." The preliminary plat currently shows sidewalks and the plat should conform to the requirements laid out in the Code of Ordinances.
RECOMMENDED STAFF ACTION:
Conditional approval of the changes as discussed at the subdivision review committee and the March 18, 2024, Planning & Zoning Commission Meeting.
