A Resolution Authorizing A Moral Claim For Tire Damage. (first reading)
Purpose and Background
The Huber Heights Police Division was assisting Riverside Police Department, who was engaged in a pursuit of a stolen vehicle north on State Route 4, into the City's jurisdiction. A Huber Heights officer set up, with stop sticks, on State Route 4 at Chambersburg Road. The Huber Heights officer observed what he thought to be the suspect vehicle, approaching in the left lane. The Huber Heights officer pulled his stop sticks onto the roadway flattening three of the four tires on the truck. As the vehicle passed by, the Huber Heights officer realized the vehicle he spiked was not the suspect vehicle. The Huber Heights officer made contact with the driver/owner of the truck and took photographs of the damaged tires. The truck was identified as a 1998 Chevrolet Silverado.
City Staff request City Council approval of a moral obligation to reimburse the owner of the truck the cost for replacement of all four tires, since all four tires will need to be replaced.
The replacement cost for the tires has been quoted at $1,027.66. A quote was received from Dayton Tire Sales, 3091 South Dixie Drive, Dayton, Ohio.
