PROCEDURES
Pursuant to A.R.S. § 38-431.02, notice is hereby given to the members of the Goodyear City Council and to the general public that the Council of the city of Goodyear will hold a meeting open to the public. Public body members of the city of Goodyear will attend either in person or by telephone conference call and/or video communication. The Goodyear City Council may vote to go into Executive Session, pursuant to A.R.S. § 38-431.03(A)(3), which will not be open to the public, to discuss certain matters. Meetings are conducted in accordance with the City Council Meetings Council Rules of Procedure adopted by Resolution No. 2025-2441.

Approval and acceptance of the proposed agreement will provide a payment to the City of $168,000 in settlement funds.

BACKGROUND AND PREVIOUS ACTIONS

The settlement stems from issues that occurred with the administration of the Professional Services Agreement over a period of time, and it was in the best interests of the City to recoup the monies owed for services rendered.

STAFF ANALYSIS

Staff recommends approving and accepting the Release of Liability Agreement attached as Exhibit "A" to Resolution 2025-2457 (included as attachment A) to resolve the City's claim regarding the breach of the Professional Services Agreement and to facilitate the payment of $168,000 in funds due to the City.

SUMMARY

The existing Memorandum of Understanding (MOU) between the City of Goodyear (City) and United Goodyear Firefighters (UGFF) Local 4005 expires on June 30, 2025. In accordance with Goodyear City Code Article 3 Section 12-14, the Meet and Confer process was started. Staff has reached a tentative agreement with UGFF on a two-year term for the new MOU effective July 1, 2025 through June 30, 2027.

STRATEGIC PLAN ALIGNMENT

RECOMMENDATION

FISCAL IMPACT

The ongoing cost to implement the MOU is estimated at $2,539,000 for Year 1 and an additional $1,426,100 for Year 2. This amount is within anticipated resources and will be included in the FY2026 City Manager's Recommended Budget.

BACKGROUND AND PREVIOUS ACTIONS

Article 3-12 of the Goodyear City Code outlines the process by which Sworn Police, Sworn Fire and eligible non-Sworn Fire Employees of the City of Goodyear and their designated representatives can Meet and Confer with the City Manager or designee relating to their wages, hours, benefits and working conditions. Negotiations between the City and UGFF, representing 151 fire safety full-time equivalent (FTE) positions, began in January 2025. After ten Meet and Confer sessions, a tentative agreement was reached and is incorporated into the new MOU, attached as Exhibit A, for Council consideration.

STAFF ANALYSIS

The two-year agreement with UGFF is an investment in the City's high-performing and valued fire safety employees. The major components of the new MOU are as follows:

This agreement is for a two-year period, beginning July 1, 2025, through June 30, 2027
Year 1 (FY2026)
· Provides 3% market adjustment for eligible members
· Provides step increase to employees not at the max of their range
· 2% increase in city contribution in deferred compensation
· July 4, Thanksgiving, and Christmas premium holidays
· Increase Stand-by pay from $2/hr to $3/hr
· Increases to specialty pay for HazMat, Paramedic Preceptor, and Paramedic Certification
· Restructure longevity to Productivity Enhancement Pay
· Recognition of out-of-state service for vacation accruals
· Additional Local Day
· Codify current discipline/investigatory processes in MOU

Year 2 (FY2027)
· Provides 3.5% market adjustment for eligible members
· Provides step increase to employees not at the max of their range
· 1% increase in city contribution in deferred compensation
· Increase Stand-by pay from $3/hr to $4/hr
· Add 1 premium holiday – Labor Day

· Increase shift differential to $0.75 second shift, $1.50 third shift, and $3 fourth shift
· Increase number of assignment pays that can be received from 2 to 3.

Proposed revisions to make current the Community Funding Program Policy originally adopted in 2001.

STRATEGIC PLAN ALIGNMENT

RECOMMENDATION

FISCAL IMPACT

There is no fiscal impact at this time. This policy is intended to inform how the Council makes Community Funding grant awards.

BACKGROUND AND PREVIOUS ACTIONS

Policy number CC-01-06 was adopted in 2001 by City of Goodyear Resolution No. 01-779 (included as Attachment B), to provide directions and guidelines upon which to base Council's Community Funding decisions.

It was the policy of the City of Goodyear to continue those social and community services that are needed and provide direct or indirect benefit to the Goodyear residents, and, without which, the city would likely spend a greater sum in order to provide the services.

The original policy included "community service support program policies," "intergovernmental agreements and memorandums of understanding policies," and a "special event funding program policy."

At the time, the Public Art Specialist reported to the Community Services division. Since adoption of the initial policy, Arts & Culture was brought under Parks & Recreation and funding for special events has been incorporated into the Arts & Culture ongoing (base) and one-time supplemental budget(s).

FY25 Strategic Plan calls for staff to "Review existing funding policy and process supporting social services in the community."

STAFF ANALYSIS

Upon review of existing funding policy and the process for supporting social services in the community, this draft Resolution 2025-2460 with Exhibit A (included as Attachment A) eliminates referenced policies that are no longer relevant and recognizes the Community Funding program as unique, competitive grantmaking on behalf of the city.
