In FY 2022-23 the City Council approved American Rescue Plan Act (ARPA) Funding in the amount of $5,144,259 for aquatic facilities. On July 25, 2023, Mayor Pro Tem Patterson Harris, Councilmember Martinez-Garcia and Councilmember McBrayer recommended a Budget Amendment in the amount of $2,178,055 for aquatic facilities. Pending the approval of the second reading of Budget Amendment 26 on the agenda today, the total amount of $7,322,314 will be dedicated to fund (3) new splash pads, (2) new playgrounds and site amenities.

Mae Simmons, Maxey and Montelongo Pools were closed in FY 2022-23 because they were beyond repair, due to age and wear. A decision was made to replace these pools with splash pads, based on information gathered through public surveys and the approved Parks, Recreation and Open Spaces Master Plan.

In October 2022, Parks and Recreation Staff contacted Kraftsman Commercial Playgrounds & Water Parks to provide quotes for design and installation of the splash pads and new playgrounds at Mae Simmons Park and Rodgers Park and a new splash pad at Maxey Park.

The purchases will be made through BuyBoard Contract 679-22. BuyBoard is a local Government Purchasing Cooperative created to increase the purchasing power of government entities and to simplify their purchasing by using a customized online purchasing system. Its purpose is to obtain the benefits and efficiencies that can accrue to members.

Purchase Orders (PO) with Kraftsman Commercial Playgrounds & Water Parks are:

PO 10026614 for $2,089,383.50, for Mae Simmons Park;
PO 10026616 for $1,477,876.00, for Maxey Park; and
PO 10026617 for $2,132,740.50, for Rodgers Park.

The total of the (3) Purchase Orders with Kraftsman Commercial Playgrounds & Water Parks, of Spring, Texas, will be $5,700,000. Demo and site work is estimated in the amount of $559,900, restroom repair and replacement budgeted at $450,000, landscaping and utilities totaling $315,000, and contingency in the amount of $297,413 brings the estimated total project cost to $7,322,314.

Preliminary schedule has construction beginning in Fall of 2023, with completion and opening in Summer of 2024.

The City of Lubbock is in receipt of a request to abandon and close a portion of an alley located adjacent to the north property line of lots 8 and 9 east of Oakridge Avenue, between 18th and 19th Streets in the Terra Estates Addition to the City of Lubbock. A new easement will be granted with the re-plat as necessary for any utilities which will remain in place.

The closure fee due to the City of Lubbock is $22,800, for the alley closure. These closures will allow Carpet Tech to provide access driveways to 18th Street.

Staff is recommending denial of this request for the following reasons:

The request only closes a portion of the alley.
The request encourages commercial traffic onto a residential street (C-4 to adjacent R-1).
The applicant has not submitted revised building plans that include the access drives being requested.

On August 23, 2018, the City Council awarded contract 14034 to Kimley-Horn and Associates, Inc. for providing environmental assessment and schematic roadway design of Upland Avenue between 66th Street to 114th Street.

On December 3, 2019, the City Council approved Amendment No. 1 to this contract to amend the scope of work to include the following:

• Right-of-way acquisition services for the Upland Avenue Corridor from 66th Street to 114th Street;
• Final design of Upland Avenue from 66th Street to 98th Street; and
• Drainage improvements design for 66th Street and Upland Avenue area.

On February 23, 2021, the City Council awarded Amendment No. 2 to this contract, to amend the scope of work to include services for an archeological survey, in compliance with the Texas Natural Resources Code, Chapter 191, the Antiquities Code of Texas (ACT).

On February 8, 2022, the City Council awarded Amendment No. 3 to this contract to amend the scope of work to include final design services for Upland Avenue paving improvements between 98th Street and 114th Street, which included drainage design, traffic control and signal plans, utility coordination, bid phase services, and construction phase services.

On November 16, 2022, the City Council awarded Amendment No. 4 to this contract to amend the scope of work to include additional right-of-way acquisition services for the Upland Avenue Paving Improvements Project between 98th Street and 114th Street.

Amendment No. 5 to this contract will amend the scope of work to include additional engineering services and right-of-way acquisition services for the Upland Avenue Paving Improvements Project between 66th Street and 114th Street. This amendment includes necessary revisions to the design plans from 66th Street to 82nd Street due to the additional MPO Category 10 fund that were received. It also includes legal services and additional work needed for design exhibits for condemnation and right-of-way acquisition processes. The term of the agreement will be extended to May 28, 2026. Contract negotiations were conducted with Kimley-Horn and Associates, Inc., and fair and reasonable hourly rates were determined for a total amount not to exceed $542,300.

Fiscal Impact

Contract Amendment No. 5 in the amount of $542,300, is funded in Capital Improvements Project 92510, Upland Avenue 66th to 82nd Street.

The Mayor's Fitness Council is hosting the 2023 United Supermarkets Lubbock Marathon in the City of Lubbock on Sunday, October 29, 2023. Organizers anticipate 1,500 athletes to participate in this one-day event. A 1-mile Kids Fun Run will be held for runners under the age of 8. Other events are a 5k (3.1 mile), a half-marathon (13.1 miles), and a full marathon (26.2 miles). The races will begin and end Downtown at the Buddy and Maria Elena Holly Plaza where there will be food trucks, local vendors, and a festive atmosphere for spectators.

The proposed resolution authorizes the Mayor to execute an agreement with the State of Texas acting through the Texas Department of Transportation (TxDOT), for the temporary closure of State right-of-way. This agreement is in the best interest of public safety and welfare of the citizens of Lubbock, to expedite all other traffic matters related to the 2023 United Supermarkets Lubbock Marathon. When a proposed tax rate exceeds the voter-approval rate or the no-new-revenue rate, whichever is lower, State law requires that the City Council must vote to place a proposal to adopt the rate on the agenda of a future meeting, as an action item. The rate proposed in the FY 2023-24 Operating Budget is $0.480164 per $100 valuation, which is higher than the 2023 no-new-revenue rate of $0.465391and lower than the 2023 voter-approval rate of $0.505718. The debt rate is proposed to increase from $0.108317 to $0.109783, and the proposed maintenance and operations rate increases from $0.348816 to $0.351999. The economic development rate also decreases in the proposed tax rate to$0.018382. This budget will raise more revenue from property taxes than last year's budget by $11.8 million which is a 11.3% increase from last year's budget. The property tax revenue to be raised from new property added to the tax roll this year is $3,796,255.

The certified values were received from the Lubbock Central Appraisal District on July 25, 2023. The calculated no-new-revenue rate and the voter-approval tax rate calculations were received from Lubbock Central Appraisal District on August 1, 2023.

The approval of this resolution is not the adoption of the tax rate, but is required for the publication of a proposed tax rate and the scheduling of a public hearing to discuss the proposed tax rate. The rate that is formally adopted by the City Council in September 2023, will follow a public hearing, two readings of the tax ordinance, and public discussion.

The Texas Constitution and Property Tax Code embody the concept of truth-in-taxation to require taxing units to comply with certain steps in adopting their tax rates. The truth-in-taxation laws have two purposes:

1. To make taxpayers aware of tax rate proposals; and

2. To allow taxpayers, in certain cases, to roll back or limit a tax increase.

The truth-in-taxation requirements are contained in the Texas Tax Code, Chapter 26.

No-New-Revenue Tax Rate:

The 2023 no-new-revenue rate is $0.465391. The no-new-revenue tax rate is a calculated rate that will provide the City with about the same amount of revenue it received during the prior year, on properties taxed in both years.

Voter-Approval Tax Rate:

The 2023 voter-approval rate is $0.505718. The voter-approval rate is a calculated maximum rate allowed by law without voter approval. The voter-approval rate provides the City with approximately the same amount of tax revenue it spent the previous year for day-to-day operations, plus a 3.5 percent increase for maintenance and operations, as well as sufficient funds to pay debts in the coming year. If the City adopts a tax rate that is higher than the voter-approval rate, an automatic election must be held on the next November uniform election date.

If the tax rate proposed by the City Council exceeds the no-new-revenue tax rate or voter-approval rate, whichever is lower, the City must follow legislative guidelines for proposing and adopting a tax rate. These guidelines include:

1. The City Council must vote to place a proposal to adopt the rate on the agenda of a future City Council meeting as an action item. The vote must be recorded. This guideline will be fulfilled with the passage of this agenda item.

2. The proposal must specify the desired rate. The City Council cannot vote to adopt a proposal to increase taxes by an unspecified amount.

3. If the motion passes, the City Council must schedule one public hearing on the proposal to increase taxes.

4. The City Council must notify the public of the date, time, and place for the public hearing, and publish information about the proposed tax rate no later 5 days prior to the date of the public hearing in a local newspaper, and publish the notice continuously at least 7 days before the public hearing, on the City of Lubbock Website and Channel 2.

5. After publishing the required notice, the City must hold the public hearing. Taxpayers must have the opportunity to express their views on the increase at the public hearing. The City Council may adopt the tax rate at the public hearing, but if they do not, they must announce at the public hearing the date and time of the meeting that they will adopt the tax rate.

6. The Tax Code requires that the City Council adopt the tax rate no more than 7 days after the public hearing.

The public hearing to discuss the proposed tax rate is scheduled for 2:00 p.m. on September 5, 2023, in the City Council Chambers in Citizens Tower, at 1314 Avenue K.
