ISSUE STATEMENT:

In accordance with Oregon Statutes and the City's charter, the City is required to complete an annual audit and financial statement. The report will be presented to the City Council at the January 5th work session. The Council will be asked to formally accept the report at their regular meeting that same night.

DISCUSSION/FINANCIAL IMPACT:

REDW, LLC, the City's independent auditors, have completed their audit of the City's Fiscal Year 2025 ACFR and have issued their opinion thereon. Ryan Pasquarella, of REDW, will review the audit process, the Independent Auditor's Report, and the City's ACFR during the work session.

As a preliminary summary for the Council's information, you may note that the auditor's found no material weaknesses in the City's internal financial controls and they issued an "unmodified opinion" on the City's financial statements. This means that the City is properly accounting for its resources and using adequate financial controls to help prevent the improper use of those resources.

Court of Record

ACTION REQUESTED:

The Council is asked to provide direction to City staff on whether to proceed with the process for the City's Municipal Court becoming a court of record.

ISSUE STATEMENT:

Beginning in January 2026, House Bill 2460, passed in Oregon's 2025 Legislative Session, requires Springfield Municipal Court to notify defendants that they can transfer their case to Lane County Circuit Court because Springfield Municipal Court is not a court of record.

DISCUSSION/FINANCIAL IMPACT:

House Bill 2460, which was passed in Oregon's 2025 Legislative Session, states that in any justice court that has not become a court of record under ORS 51.025, a defendant charged with a misdemeanor crime must be notified immediately after entering a plea of not guilty of the right to have the case transferred to the circuit court for the county where the justice court is located.

Starting in January 2026, the City's judges will need to include this notice in their advice of rights at arraignment. Since Springfield is not a court of record, a defendant could request to have their case transferred to Lane County Circuit Court as the court of record for the County. Once that request is made, Springfield Municipal Court would no longer have jurisdiction, and the case would become a Lane County matter.

As a city with a municipal jail, the Council may have an interest in becoming a court of record.

Becoming a court of record would require the City to pass an ordinance declaring the City to be a court of record and filing a declaration with the State of Oregon that the City satisfies the statutory court of record requirements.

Being a court of record would require recording software and equipment in both courtrooms, storage for recordings, and two clerks in court – one to handle live data entry and docket management and another to manage the recording process.

The financial impact to the City would be approximately $10,400 annually for a software subscription that covers both courtrooms and includes unlimited cloud storage. Both courtrooms are already outfitted with audio/visual equipment that is compatible with the software. The City also currently has a budgeted, but vacant, court clerk position that, if filled, would provide the ability to have two clerks in the courtroom during court sessions.

Regional Wastewater Expansion and Metro Plan Amendment Discussion for Goshen and Creswell.

ACTION REQUESTED:

Provide policy direction and feedback on whether the City of Springfield supports extending Metropolitan Wastewater Management Commission (MWMC) wastewater services to areas outside the current service boundary, including Goshen, the Short Mountain Landfill, the City of Creswell, and Junction City, for purposes of shaping a potential Eugene-Springfield Metro Plan amendment.

No formal action is requested at this time.

ISSUE STATEMENT:

Lane County is preparing to sponsor a Type III amendment to the Eugene-Springfield Metro Plan to allow wastewater services outside the current urban growth boundary. The amendment would enable regional wastewater connections to address long-standing infrastructure limitations affecting industrial development in Goshen, regulatory compliance challenges facing the City of Creswell, and operational inefficiencies associated with hauling landfill leachate from the Short Mountain Landfill. In November 2025, the Metropolitan Wastewater Management Commission (MWMC) was briefed on the proposed expansion of the regional wastewater project and supported continuing discussions with the affected jurisdictions regarding potential service extensions and connection cost methodologies. Lane County is seeking early policy-level feedback from Springfield City Council to inform the scope and structure of the proposed amendment prior to initiating formal land use proceedings.

DISCUSSION/FINANCIAL IMPACT:

This is an informational work session and discussion item only. There is no direct fiscal impact to the City of Springfield associated with this agenda item at this time. Planning-level capital cost estimates for the proposed regional wastewater expansion range from approximately $72.6 million to $79.9 million (2023 dollars), with connection costs proposed to be assessed using existing Metropolitan Wastewater Management Commission (MWMC) and City of Springfield System Development Charge (SDC) methodologies.

Additional technical analysis is underway to evaluate system capacity considerations and potential impacts to the City of Springfield's wastewater conveyance system, including the Franklin/McVey trunk line. Any future commitments related to providing dedicated City of Springfield capacity, or actions necessary to ensure adequate capacity to meet Springfield's long-term growth needs, would return to City Council for consideration through separate, formal actions.

A RESOLUTION AUTHORIZING THE SECOND RESTATED AND AMENDED INTERGOVERNMENTAL AGREEMENT FOR THE METROPOLITAN WASTEWATER MANAGEMENT COMMISSION, AND THE FIRST RESTATED AND AMENDED INTERGOVERNMENTAL AGREEMENT FOR THE PROVISION OF OPERATION, MAINTENANCE AND ADMINISTRATIVE SERVICES TO THE METROPOLITAN WASTEWATER MANAGEMENT COMMISSION

ISSUE STATEMENT:

Two foundational intergovernmental agreements regarding the MWMC have been updated to reflect current practices and to simply some processes. Before these changes can become effective, adoption is required by all three parties to the MWMC's Intergovernmental Agreement, including the Springfield City Council.

DISCUSSION/FINANCIAL IMPACT:

The City of Springfield, the City of Eugene, and Lane County (Parties), have successfully managed the Metropolitan Wastewater Management Commission (MWMC) partnership for over four decades. The MWMC was formed in 1977 by the Parties through intergovernmental agreement (IGA). The MWMC's IGA was last updated in a comprehensive manner in 2005. The MWMC's Operations and Maintenance Intergovernmental Agreement (OM&A) was last updated in 2001. The OM&A is an agreement between the cities of Eugene and Springfield regarding the provision of operations, maintenance and administrative services in connection with the MWMC's regional wastewater facilities. Lane County is not a party to the MWMC OM&A.

The proposed amendments to the MWMC IGA (Attachment 2) and OM&A (Attachment 3) are largely administrative in nature, and reflect housekeeping edits, updated recitals, the removal of historical references that are no longer needed or no longer make sense, updated definitions, and ensuring defined terms are used consistently throughout both documents. The City Attorneys from Eugene and Springfield worked closely with the MWMC's legal counsel over several months to propose the final draft documents. Lane County legal counsel was also conferred with regarding changes to the IGA. The MWMC Board discussed both draft documents at their November 15, 2025, meeting, and directed staff to move the documents forward to the Partiees for review and approval. The MWMC's Executive Director discussed the proposed amendments to the IGA and OM&A with the Springfield City Council at work session on December 8, 2025. Council directed staff to move the agreements and associated Resolution (Attachment 1) forward for adoption at the January 5, 2026, regular Council meeting.

Prior to becoming effective, the MWMC's IGA will need to be adopted by the City of Eugene and Lane County. The OM&A will also need to be adopted by the City of Eugene. Lane County is scheduled to adopt the updated IGA at their January 27, 2026, Board of County Commissioners meeting. The City of Eugene is scheduled to adopt the IGA and the OM&A at their January 28, 2026, City Council meeting.

Appoint Jim Lauinger to a full term ending December 31, 2029.

ISSUE STATEMENT:

The Library Advisory Board has one (1) member who has completed a full term and is seeking re-appointment to a second full term. The LAB also has one (1) vacant position, due to the expiration of one (1) board member's term.

Mayor VanGordon gave permission for the direct reappointment of LAB member Robyn Louden. Three (3) applications were received for the one (1) vacant position. Two (2) applicants withdrew. Jim Lauinger was interviewed on November 24, 2025. Council gave direction to appoint Mr. Lauinger.

DISCUSSION/FINANCIAL IMPACT:

The City received four (4) applications for LAB during the open recruitment period which closed September 26, 2025. Board member Robyn Louden reapplied and was directly reappointed by the Mayor. The LAB has one (1) vacant full-term position.

The LAB requests that the Council formally ratify the appointment of Jim Lauinger to a full term ending December 31, 2029, at the January 5, 2026 Regular Session.

A RESOLUTION DELEGATING TO THE SPRINGFIELD ECONOMIC DEVELOPMENT AGENCY (SEDA) THE NEGOTIATION OF A BINDING AGREEMENT FOR THE DEVELOPMENT OF CITY OWNED PROPERTY LOCATED AT 538 MAIN STREET

ISSUE STATEMENT:

The project proposed by Obie Companies Incorporated on City-owned property at 538 Main Street engages both the City Council and SEDA; delegating the project to one decision-making body will maintain efficiency and clarity.

DISCUSSION/FINANCIAL IMPACT:

The City executed a Memorandum of Understanding (MOU) with Obie Companies Incorporated, Developer, on October 15, 2025. The MOU provides e a framework for negotiations and the preparation of a future Binding Agreement for the disposition and development of City-owned property at 538 Main Street. Developer has proposed a four-to-five story building of studio, one-bedroom, and two-bedroom apartments with ground floor active use.

The MOU identifies discussions for both the City Council and the Springfield Economic Development Agency (SEDA). To maintain efficiency and clarity between the Developer, the City, and SEDA, staff have prepared a Resolution (ATT 1) and a Delegation Agreement (ATT 2) to delegate negotiations from the City to SEDA specifically for this project.

The interests in bringing this development project to fruition are shared between the City Council and SEDA, and the proposed development project aligns with the work of SEDA. The Downtown Urban Renewal Plan identifies that SEDA may undertake a project such as this to further its goals of growth of the tax base and partnership in public/private development and redevelopment efforts.

The Delegation Agreement would assign all development negotiations to SEDA. Any future binding agreement will require decision by the City Council, SEDA, and the Developer. Because SEDA is made up of the City Council members, the Council will be kept apprised of project progress.

ISSUE STATEMENT:

The Planning Commission has two vacancies as the result of Commissioner Buck's appointment to City Council and Commissioner Webber not applying for a second term. Commissioner Buck resigned as of October 21st, 2025 and Commissioner Webber's four (4) year term expired December 31st, 2025.

DISCUSSION/FINANCIAL IMPACT:

On November 24th and Dec. 1st, Council held three (3) interviews to fill two (2) vacancies on the Planning Commission, which are the result of Commissioner Buck's resignation and Commissioner Webber's four (4) year term expiring at the end of the year.

The Springfield Planning Commission is a seven-member volunteer Commission appointed by the City Council. The members serve four-year terms that are staggered. Positions are "at-large" and do not represent specific geographic areas. Of the seven members, two may live outside the city limits (but within the Urban Growth Boundary) and two may be involved in the Real Estate profession. No more than two voting members shall be engaged in the same kind of business, trade, profession or occupation. At present, no two Commissioners are involved in the same profession and all Commission members reside within the city limits.

One appointment will fill the remainder of Commissioner Buck's term and will be effective immediately and expire December 31st, 2028. The other appointment will be effective immediately and expire December 31st, 2029.

DISCUSSION/FINANCIAL IMPACT:

Per Springfield Municipal Code section 2.275, within 40 days after an election and after receiving the vote tally for nominated or elected officers and measures, the Elections Filing Officer will proclaim to the City Council the candidates nominated or elected and measures approved. The City received the General Election Abstract from Lane County Elections on December 1, 2025. The statewide General Election was held on November 4, 2025, and ballot measure 20-371, 5-Year Fire and Life Safety Services Local Option Levy was approved by the voters.

No formal action by the City Council to approve the Proclamation is required; the Council is requested to accept the Proclamation.

The Springfield Arts Commission has one (1) commissioner who has completed a partial term and is seeking appointment to his first full term. The Springfield Arts Commission also has four (4) vacant positions, due to one (1) unfilled vacancy in 2024, and the exit of three (3) commissioners in 2025.

Six (6) applications were received for the four (4) vacant positions. Three (3) applicants withdrew. Brittney Allgauer, Gregory Hayes and Charly Swing were interviewed on November 24, 2025. Council gave direction to appoint Ms. Allgauer, Mr. Hayes, and Ms. Swing.

Mayor Vangordon gave direction during open recruitment in 2025 to approve commissioner Grimes for his request to continue service and appoint him to his first full term.

DISCUSSION/FINANCIAL IMPACT:

The City received six (6) applications during the open recruitment period which closed September 26, 2025, and the request of one commissioner to continue his service upon completion of his first partial term. The Springfield Arts Commission has four (4) vacant positions and one (1) commissioner appointment due for renewal for a first full term.

The Bicycle & Pedestrian Advisory Committee (BPAC) currently has three vacancies, one of which resulted from a resignation in November 2025. Mr. Keith Dickey is completing his first three-year term, including two years of service as Chair, and has expressed interest in serving a second three-year term.

DISCUSSION/FINANCIAL IMPACT:

The Bicycle and Pedestrian Advisory Committee (BPAC), which is authorized for nine voting members, currently has three vacancies. One vacancy resulted from the resignation of Jenya Kielpinski in November 2025, and two vacancies resulted from members completing their three-year terms. One of these members, Mr. Keith Dickey, is eligible and has expressed interest in serving a second three-year term.

Appointment of one new member at this time would bring BPAC membership to seven members, with the expectation that the remaining vacancies will be filled through the 2026 recruitment process.

Savannah Olsen reapplied to serve on the CDAC and Council Leadership decided there was no need to interview her. The Mayor and Council interviewed Mike Koivula and Conor Gagner during the November 24, 2025 work session. They interviewed Wendy Werner during the December 12 work session as she had also applied for the Planning Commission.

DISCUSSION/FINANCIAL IMPACT:

The existence and work of the Community Development Advisory Committee (CDAC) are important expressions of the desire for community participation in the City's housing and community development activities. The CDAC provides recommendations to the City Council on short and long term housing and community development needs, objectives, priorities and planning documents as required by federal U.S. Department of Housing and Urban Development (HUD) program regulations. The CDAC also provides recommendations to the City Council on the best use of the City's allotment of federal Community Development Block Grant (CDBG) program funds. These funds could be used to support housing programs, social services, affordable rental and home ownership housing development, neighborhood revitalization activities, parks and street construction and downtown redevelopment.

Downtown Parking Management Services Contract

ACTION REQUESTED:

Authorize the City Manager to award the Request for Proposals for Downtown parking management to Diamond Parking Services, LLC and enter into Contract #4060.

ISSUE STATEMENT:

The City of Springfield issued a Request for Proposals for Downtown parking management services; a notice of intent to award has been issued, and a contract has been prepared for City Council's review.

DISCUSSION/FINANCIAL IMPACT:

The City of Springfield's Downtown parking program is focused on serving visitors. Well-managed parking areas Downtown establish a flow of vehicles in the City's designated hourly and on-street parking areas. This flow of vehicles is good for businesses, allowing customers to easily park their vehicles for a controlled amount of time, and enjoy eating, shopping, and leaving to allow others to park. Well-managed parking also permits the sale of parking permits for designated areas where vehicles can stay all day. As Downtown becomes more developed, it will be essential to maintain good parking habits to ensure that vehicle flow occurs in hourly areas and vehicle stagnation occurs in permit-sale areas.

Staff issued a competitive procurement process (a Request for Proposals, RFP) which resulted in the intent to award to Diamond Parking Services, LLC. A draft contract including the solicitation documentation is included as Attachment 1. The City of Springfield's previous contract for parking management ended after ten years. C# 4060 proposes three one-year terms with three one-year extensions for a total fixed contract value of $1,227,212.

The proposed fee structure is standard for the parking management industry. The management fee is payment to the contractor for services provided; the remainder of the costs are reimbursable costs based on infrastructure and staffing needed for services provided. All revenue from permit sales and citations returns to the City. An incentive fee on gross revenue is proposed to assist in ensuring Springfield receives consistent, productive enforcement to support the flow of vehicles and the health of Downtown. Gross revenue is total revenue generated before expenses are deducted. Gross revenue includes citations paid; it does not include citations issued. Enforcement will continue to emphasize education and customer service, provide flexibility and options for parking patrons, and ensure that Downtown stays open for business.

In 2010 the City Council adopted Resolution 2010-58 to implement a parking management plan. Elements of that plan are codified in the Springfield Municipal Code Sections (SMC) 6.005-6.075, to establish the managed parking areas, and methods for enforcement. SMC 6.060 identifies that the City may enter into an agreement with a private company to enforce SMC 6.005-6.075.

Parking pass and citation rates are established by City Council and are considered annually during the Master Fees and Charges process.

ITEM TITLE:

Comcast Franchise Extension Ordinance

ACTION REQUESTED:

Conduct a first reading of the following ordinance: An ordinance to extend the terms of Ordinance 6208 granting Comcast of Oregon II, Inc. a franchise for operation of a cable telecommunications system, adopting a severability clause, and providing an effective date.

ISSUE STATEMENT:

Council action is requested to extend Comcast's existing cable television franchise to June 30, 2027. If not approved and extended, the franchise agreement expires December 31, 2025. This ordinance only extends the expiration of the franchise with all other terms and conditions remaining the same.

DISCUSSION/FINANCIAL IMPACT:

The Franchise: Together, Lane County, the City of Eugene, and the City of Springfield have granted Comcast a franchise for the operation of a cable communications system. In 2007, the three entities amended and renewed Comcast's franchise through August 1, 2018.

The Extensions to Date: The term of the franchise has been extended several times, most recently to January 1, 2026, with Ordinance 6491. Initially, the extensions resulted from delays while staff tried to resolve a dispute with Comcast arising from a franchise fee review the jurisdictions conducted. This review resulted in staff attempting to resolve fee review issues while also trying to negotiate the terms for the franchise renewal. Additional delays have stemmed from the departure of Comcast personnel who had been working on the franchise renewal.

In 2019, the Federal Communications Commission (FCC) adopted rules regarding cable regulations which were unfavorable to local government franchising authorities and are affecting franchise negotiations. For example, the order not only allows cable operators to offset from their 5% franchise fees the value of "cable related, in-kind contributions," such as free service or cable boxes in government buildings, it prohibits local franchising agencies from charging cable operator's additional fees – aside from the 5% cable franchise fee – for use of the public rights-of-way to provide other services, including broadband internet. The parties paused negotiations for a period of time while legal challenges moved through the federal courts of appeals.

The previous extension has allowed progress on several points over numerous drafts including agreement on a Competitive Equity provision assuring equivalent treatment to competitive video programing services as Comcast receives, as well as tentative agreement of the mechanism by which Comcast will notify the City if it intends to charge for currently free cable services to public facilities, newly allowed under the 2019 FCC Cable Order. Comcast states it does not have plans to do this at this time.

Presently, Comcast, Eugene, Lane County and the City continue to exchange drafts often requiring legal review from all parties. Comcast seeks to transition to per-subscriber fees to fund PEG grants that are currently funded through a lump sum. PEG refers to public, education, and government access channel fees used for capital costs to support these programs. This would likely decrease the overall fee amount received and will necessitate continued negotiation with Comcast to resolve. Tim Goodman, Sr. Director of Government and Regulatory Affairs for Comcast, stated to Eugene's City Council on November 17, 2025 that Comcast is optimistic about completing the negotiation before the expiration of this extension.

This proposed ordinance requesting an extension would extend only the term of the current franchise to June 30, 2027. All other franchise terms and conditions would remain the same. When negotiations are completed, the proposed franchise renewal agreement will be brought to the City Council for action.

ISSUE STATEMENT:

The City Council is requested to consider an ordinance to annex 5.67 acres of property zoned and designated Employment Mixed-Use - Glenwood located at Map 17-03-34-44, TLs 800, 900, 1100, 1200, 1402 in west Springfield (Glenwood). The proposed annexation is requested to facilitate connection to city services.

DISCUSSION/FINANCIAL IMPACT:

The City Council is authorized by Oregon Revised Statutes (ORS) Chapter 222 and Springfield Development Code (SDC) 5.7.100 to act on annexation requests. In accordance with SDC 5.7.155 and ORS 222.040, 222.180 and 222.465, if approved the annexation will become effective 30 days following Ordinance adoption and signature by the Mayor, or upon acknowledgment by the State, whichever date is later.

The territory requested for annexation is an improved mixed-use lot at Map 17-03-34-44, TLs 800, 900, 100, 1200, & 1402. The properties are zoned and designated for Employment Mixed-Use - Glenwood with an Urbanizable Fringe Overlay (UF-10), and it is located inside the City's Urban Growth Boundary (UGB). The UF-10 overlay will no longer apply upon annexation.

As outlined in the attached staff report (Attachment 2, Exhibit D), the annexation area can be served with the minimum level of key urban facilities and services as required in the Springfield 2030 Comprehensive Plan – Urbanization Element. The attached staff report also confirms the request meets the criteria of approval for annexations established in SDC 5.7.140. Staff recommend the Council approve an Annexation Agreement for this property to ensure that fiscal impacts to the city associated with future redevelopment of the site are appropriately mitigated.

Recommendation: The subject property complies with the standards and provisions of the SDC and applicable ORS for annexation; Council is requested to conduct the first reading and quasi-judicial public hearing of the ordinance annexing this property to the City and withdrawing from the Glenwood Water District.

Staff has corrected these errors, specifically those stating 'withdrawal from the Willakenzie Rural Fire Protection District and the Glenwood Water District.' The public rights-of-way that were annexed were already located within the Eugene-Springfield Fire Department service area. Likewise, the ROWs are not located in the Glenwood Water District, but actually are within the Rainbow Water District.

This ordinance corrects these errors so that the appropriate special service districts are listed.

DISCUSSION/FINANCIAL IMPACT:

Scrivener's errors were found in the original Aspen Street/Menlo Loop annexation ordinance (No. 6499), which made reference to erroneous special service districts.

ACTION REQUESTED:

ISSUE STATEMENT:

The City Council is obligated to appoint an Interim Councilor consistent with the Springfield Charter, Council Operating Policies and Procedures, and Council direction.

DISCUSSION/FINANCIAL IMPACT:

Purpose/Background Information: The purpose of this item is to ask the Council to accept Councilor Blackwell's resignation and declare the Ward 4 seat vacant. Staff will bring back a proposed process for public hearing and approval at the January 20, 2026, regular session.

Legal Requirements/Qualifications: The Interim Councilor must live in Ward 4, not be a candidate for more than one elective City office, disclose any adult felony convictions and not be a City employee. The Council may also set additional qualifications. Deliberations and appointment must occur at a regular session meeting and are subject to public meetings law requirements and Council procedure. Liability can be avoided by following the adopted process and applying it consistently to all candidates.

Councilor Blackwell's term is set to expire on December 31, 2028. Normally, her seat would be up for election at the May 2028 primary election with a new term starting on January 1, 2029; however, since she is resigning so early in her term, the election for her seat will be at the next upcoming November 2026 statewide general biennial election and the term will last for two years.

Interim Councilor Selection Process: The Council Operating Policies and Procedures require that the Council formally accept a Councilor's resignation and hold a public hearing before adopting a process for appointing an interim councilor.

The main components of filling the vacancy are advertisement and recruitment, candidate evaluation, and deliberation and appointment. Advertisement and recruitment include publicizing the vacancy and providing a method for candidates to express their interest via a written application. Candidate evaluation includes using information like a written application and an in-person interview to determine whether the candidate is qualified to move forward to deliberations. In recent vacancies, the application has been open for approximately 30 days and the total process lasts about two months.
