PURSUANT TO RESOLUTION 11, SERIES 2022, PUBLIC COMMENT:

--Individuals may comment regarding items on the Council agenda or any other topic they wish to address the City Council about, including items discussed in a previous Council Workshop. Those wishing to comment must register by completing an "Intent to Speak" card (located outside of the Council chambers). Completed cards will be collected at the start of the meeting and delivered to the Mayor, who will call each speaker to the podium at the appropriate time. Comments specific to agenda items scheduled for public hearings should be reserved and delivered during the public hearing session.

DISCUSSION

Application for a Conditional Use Permit for temporary food product sales located at 145 E Main St. Cortez, CO, zoned CBD, Central Business District.

BACKGROUND

The applicant, Bell Beef, with written permission from the property Owner, is requesting approval of a conditional use permit to establish a temporary food product sales trailer on the vacant property located at 145 E. Main Street.

FISCAL IMPACT

RECOMMENDATION

Staff recommends the City Council approve a resolution approving the application for the conditional use permit for the proposed mobile vendor on property located at 145 E Main St., Cortez, Colorado, in the Central Business District (CBD) zone and state any conditions it feels would be necessary to ensure compliance with the Land Use Code.

MOTION

If the City Council agrees with the Staff recommendation, a possible motion would be as follows:
I move that the City Council approve Resolution No. 5, Series 2024, a resolution approving a Conditional Use Permit to establish a temporary mobile vendor on 145 E. Main St, with the conditions of approval stated in the Resolution.

DISCUSSION

In considering an application for a new liquor license, Council is directed by State Statutes to determine the needs of the neighborhood, the desires of the residents of the neighborhood, and to verify that the applicant is of good character. Fingerprints for Cole Clark were sent to CBI and individual history records have been completed.

Chief of Police Vern Knuckles will be present at the meeting to give the report from the Police Department. A copy has been attached for your review. A sign was posted on the premises and a public hearing notice was published according to regulations. Copies of the petitions circulated by the Police Department have also been included in the packet.

BACKGROUND

The application referred to above was filed in the office of the City Clerk on February 7, 2024. The application appears to be complete. Elevated Liquors, LLC., DBA Elevated Liquors is located 530 North Broadway, Cortez.

RECOMMENDATION

Staff recommends that after considering the reasonable requirements of the neighborhood, the desires of the adult inhabitants, the necessity of any restrictions on the license, the good character of the applicants, and compliance with all the provisions of Colorado Revised Statutes 44-3-301, that Council approve a new Retail Liquor Store License for Elevated Liquors, LLC., DBA Elevated Liquors, located at 530 North Broadway, Cortez.

MOTION

If agreed upon by the City Council, a possible motion would be:

I move that after considering the reasonable requirements of the neighborhood, the desires of the adult inhabitants, the necessity of any restrictions on the license, the good moral character of the applicants, and compliance with all the provisions of C.R.S. §§ 44-3-301(2)(a) and 44-3-312(2)(a), City Council approve a new Retail Liquor Store Liquor License for Elevated Liquors, LLC., DBA Elevated Liquors, located at 530 North Broadway, Cortez.

DISCUSSION

The two districts have similar use standards and the same density standards. The major difference is that the MH District allows for manufactured homes, manufactured home parks and manufactured home subdivisions while requiring conditional use permits for multi-family uses.

BACKGROUND

The .66 acre parcel is currently zoned R2, Residential Multi Family. The applicant is requesting a rezone to MH, Residential Manufactured Housing Zone.

FISCAL IMPACT

Not studied

RECOMMENDATION

The Planning Commission recommended approval of the requested rezoning by a vote of 4 – 1.
Staff recommends approval of the rezoning request with the following findings:
a. The Property is adjacent to and accessed through neighborhoods developed and zoned MH.
b. The community will benefit from use of the Property by the development of a currently vacant parcel within City limits.
c. Adequate facilities are available to be extended to serve development for the type and scope
suggested by the proposed zone.
d The proposal in conformance with the policies, intents and requirements of the Cortez comprehensive plan.

MOTION

If the City Council agrees with the Staff recommendation, a possible motion would be as follows:
I move that the City Council approve on first reading Ordinance No. 1326, Series 2024, and set a public hearing for April 23, 2024, to consider the requested rezone from R2, Residential Multi Family to MH, Residential Manufactured Home District, for the .66 acre parcel identified in the Ordinance.

Purchase of Two New Air Compressors for the Water Treatment Plant

DISCUSSION

The Public Works Water Division needs to replace the two air compressors at the Water Treatment Plant. The current 5-HP Gardner Denver air compressors have been in service for 17 years. Both air compressors have exceeded their life expectancy of 30,000 hours, with one compressor having 47,000 hours and the other having 42,000 hours. The compressors that are currently being used no longer produce a sufficient volume of air independently to keep up with the demand of the membrane treatment plant; therefore, both compressors need to run simultaneously to keep up with demand. This leaves us with no redundancy if a failure were to occur.

BACKGROUND

City staff put together a set of specifications and advertised on BidNet (72 contacts) for two new 10-HP tank-mounted air compressors with air dryers. All of the compressors that were bid come with a 3-year warranty period. Bids were opened on March 13, 2024, with the following results:

Taking into consideration price and availability, City staff recommends purchasing two new Champion Model #HQR10-12, 10-HP tank-mounted air compressors with sound-attenuating enclosures, 120-gallon tanks, and attached air dryers from REMCO ($12,025 each) for a total amount of $24,050.00.

FISCAL IMPACT

This purchase is fully covered through funds in the Water Capital Outlay account. Additionally, since the Water Division is an Enterprise Fund, this purchase does not affect the General Fund Equipment Account.

RECOMMENDATION

Staff recommends that Council approve the acquisition of two new air compressors for the Water Treatment Plant from REMCO ($12,025 each) for a total amount of $24,050.00. to be fully covered by funds budgeted in the Water Capital Outlay account.

Award of the 2024 Concrete Cost-Share Project

DISCUSSION

After reviewing the cost-share applications and needed areas of repair, Public Works' staff compiled bid documents and advertised the project on the City's website, BidNet (631 contacts), and in the Cortez Journal. Five sets of plans were picked up from the Service Center by interested parties. The bid opening was held on March 12, 2024, with two bids received.

BACKGROUND

The City of Cortez provides an annual sidewalk cost-share program to help residents and business owners either install new sidewalk or replace deteriorated sidewalk on their property. The program encourages and promotes improvement of our public walkways by offering a 50% cost-share agreement with local residents and businesses. The City also utilizes this project for maintenance on further sidewalks, in addition to ADA accessible ramps, curbs, and gutters. This year's project includes removal and replacement of approximately 667 SY of damaged concrete sidewalk; 352 SY of new concrete sidewalk; 1141 LF of curb and gutter; 118 SY of ADA curb ramps; 12 light pole bases, complete-in-place poured caisson, with conduit; and miscellaneous other concrete work throughout the City.

FISCAL IMPACT

The Street Capital Fund has a total of $388,639 budgeted for concrete, curb and gutter replacement, capital improvements, and downtown improvement work this year. There are seven citizens and/or businesses that are participating in this year's concrete cost-share project.

RECOMMENDATION

Staff recommends that the 2024 Concrete Cost-Share Project be awarded to K&K Concrete Inc. at its bid price of $349,816.00. This is approximately 11% lower than the Engineer's Estimate and $38,823.00 under budget. According to the City's Local Vendor Preference, Daniel's Concrete, a local bidder, would have to have been within 2% of K&K's bid to receive preferential treatment, which they were not.

MOTION

If agreed upon by the City Council, a possible motion would be:

I move that City Council accept the bid and award the 2024 Concrete Cost-Share Project to K&K Concrete at its bid price of $349,816.00.

CML Letter - Support Partnership, Not Preemption

DISCUSSION

The Colorado Municipal League (CML) is working on multiple fronts to keep local control local, and home rule at home when it comes to matters of land use and housing. CML is reaching out to local elected officials to consider signing on to CML's letter to members of the Colorado General Assembly asking for their support for housing legislation that emphasizes "partnership, not preemption."

BACKGROUND

Last year, Colorado municipal leaders pledged to work as partners with Gov. Polis and proponents of affordable housing legislation toward common goals. Unfortunately, 2023 represented a missed opportunity with legislation focused on land use preemption instead of collaborative outcomes.

Staff recommends that Council authorize the Mayor to sign the online CML letter to the Colorado General Assembly to support partnership, not preemption.

DISCUSSION

At the regular City Council meeting on February 27, 2024, a concern was raised during the public comments section that two members of the Council allegedly violated some rules governing quasi-judicial matters in relation to a rezoning request this past year. Council wishes to thank the member of the public who brought this issue to our attention and wishes to consider adopting this Position Statement in response to the public comments.

RECOMMENDATION

Staff recommends that City Council adopt the Position Statement of the Cortez City Council Regarding Compliance with Quasi-Judicial Hearing Rules.
