MINUTES OF THE BOARD OF ADJUSTMENT OF THE CITY OF MUSKOGEE, OKLAHOMA MET IN THE COUNCIL CHAMBERS OF CITY HALL JUNE 11, 2024
Members of the Board of Adjustment of the City of Muskogee, Oklahoma, met in a Regular Scheduled Meeting, on June 11, 2024, at 2:00 p.m., in Council Chambers, Municipal Building, 229 W. Okmulgee Ave., Muskogee, Oklahoma.

The meeting was called to order by Stacy Alexander and the roll was called as follows: |

Motion was made by Board Member Steve Dennis, seconded by Board Member Toni Cotton to consider approval of Board of Adjustment minutes of February 13, 2024. | |||||||||||

2 | Hold a public hearing and make a determination on the variance request to 90-16-07(G)(3)(a) Commercial and Industrial District Sign Regulations to allow for a digital billboard sign to replace an existing wooden billboard in a C-1 Local commercial zoning district located at 1146 South Main Street, or take other necessary action. (Jody King) Jody King spoke about Dyke Properties LLC having applied for a variance to 90-16-07(G)(3)(a) Commercial and Industrial District Sign Regulations to allow for a digital billboard sign to replace an existing wooden billboard in a C-1 Local commercial zoning district. Stating The City of Muskogee Code of Ordinances states: "Digital signs shall be allowed only in C-2, C-3, I-1, I-2, and P Districts, or lots that abut the Highway Commercial District." However, under section 90-16-07(G)(3)(b), a digital sign may be allowed with approval from the Board of Adjustment. Through the strict application of the zoning ordinance, there is not an unnecessary hardship because subsection b gives a remedy to subsection a. With this at play, the variance becomes a request to allow the sign to exist under 90-16-07(G)(3)(b) with approval by the Board of Adjustment, allowing Dyke Properties LLC to continue with the installation of their sign. Tom Harris, employee of Experius LED Signs, gave a handout to the Board with photos of the location, an existing billboard sign, and an updated LED sign. He described how the LED sign wouldn't be so bright and blinding and explained how this is a setting that can be controlled. Stacy Alexander asked how the size differentiates from a traditional static sign. Tom Harris stated that this sign would be smaller than a traditional static sign. |
