RECOMMENDATION
Staff recommends that City Council approve the Memorandum of Understanding for the donation of the surplus Emerson 30KVA Uninterruptible Power Supply (UPS) Unit to Yellowstone County.
BACKGROUND (Consistency with Adopted Plans and Policies, if applicable)
The City of Billings designated our Liebert/Emerson 30KVA Uninteruptible Power Supply (UPS) Unit, currently in production at 210 N. 27th Street, as surplus. A decision was made to keep this UPS in production to provide critical power protection to our core Enterprise & Public Safety computer systems while the new City Hall was being remodeled. The new UPS units, which have lithium batteries, extended run times, and longer life cycles, were included in the remodel of the new City Hall. By maintaining the old units and purchasing new units for the new City Hall, we were able to keep our existing environment fully operational while systematically migrating all network resources and services to the new City Hall location.
We were unable to find a use for the existing Emerson UPS within city departments and so the unit was designated as surplus. We reached out to several local government agencies and Yellowstone County showed interest resulting in the MOU before you tonight.
The Emerson 30KVA unit will be taken out of service on or before February 14th, 2025. The MOU outlines that Yellowstone County will be responsible for all expenses related to removing the UPS from City Hall between February 18, 2025 and March 14, 2025.

- Approve; the MOU to donate the surplus Emerson 30KVA UPS to Yellowstone County or,

FISCAL EFFECTS
The Memorandum of Understanding (MOU) calls for the City to donate the Emerson 30KVA UPS Unit at no cost to Yellowstone County. Yellowstone County will assume all responsibility and related expenses for the removal of the UPS from City Hall at 210 N. 27th Street and all current and future expenses related to transporting the UPS to their facility, installation, setup, maintenance, and care. The City of Billings will NOT incur any expense related to the donation of the Emerson 30KVA UPS to Yellowstone County.
