RECOMMENDATION

Staff recommends that Council conduct a public hearing and approve the resolution creating SID 1429 Clearwater Estates Subdivision, 2nd Filing and 44 West Subdivision Streetlights.

EXECUTIVE SUMMARY

Brown Development LLC and McCall Development Inc. have petitioned the City to create Special Improvement District (SID) 1429 to finance streetlight improvements within Clearwater Estates Subdivision, 2nd Filing, and 44 West Subdivision. The developments are located south of Central Avenue near Shiloh Road, and the proposed streetlights will serve all street frontages. The estimated cost of the improvements is $1,110,000 and will be financed through SID bonds, with costs assessed to properties within the district; any costs exceeding the estimate will be paid by the developers. 

The developers have previously constructed approximately $3.99 million in public infrastructure improvements, including streets, water, sewer, and storm drainage systems, which satisfy the City's Raw Land District requirements. Staff recommends that Council conduct the required public hearing and approve the resolution creating SID 1429. If the SID is not approved, the developers would be responsible for funding and constructing the streetlight improvements without SID financing.

BACKGROUND (Consistency with Adopted Plans and Policies, if applicable)

Brown Development LLC and McCall Development Inc., the developers of Clearwater Estates Subdivision, 2nd Filing and 44 West Subdivisions, desire to construct public improvements within the subdivisions, including streetlight improvements. These improvements are proposed to be completed through a special improvement district, as authorized under the Subdivision Improvements Agreement for the subdivisions. The subdivisions are located south of Central Avenue near Shiloh Road, and streetlights will be installed along all street frontages. The streetlights will be maintained by the Homeowners Association until the Clearwater and 44 West developments are completed, at which time a Special Improvement Light Maintenance District (SILMD) will be established for ongoing maintenance.

Brown Development LLC and McCall Development Inc. previously constructed streets and underground utilities, including water, sewer, and storm drain infrastructure, within Clearwater and 44 West Subdivision, totaling $3,988,660.57 in improvements. These improvements are credited toward satisfying the City’s Raw Land District Requirements (Resolution No. 05-18234) and represent approximately 78.2% of the total project costs, including streets, utilities, and streetlight improvements. The public hearing was advertised in the Yellowstone County News on June 5 and June 12, 2026.

FISCAL EFFECTS

The total estimated costs of the improvements are $1,110,000.00, which will be paid for from the sale of SID bonds and assessed to the properties within the SID boundary. If the costs are greater than the estimated amount, the developer will pay the additional cost.

ALTERNATIVES

The council may:
  • Conduct a public hearing and approve the resolution creating SID 1429; or,
  • After holding a public hearing, not approve the resolution creating SID 1429.  If not approved, the developer will have to install streetlights and park improvements at their cost.
