RECOMMENDATION
Staff recommends Council hold a public hearing and receive public comment concerning the Purchase and Sell Agreement (PSA) for Lampman Park. Staff recommends Council approve the PSA with Cal Kunkel, for the disposition of Lampman Park, located at 3050-3104 Monad Rd, Billings, MT 59102.
EXECUTIVE SUMMARY
Lampman Park is approximately 6.04 acres of dedicated parkland in the Lampman Subdivision (Geocode 03-0926-12-3-23-06-0000), recorded in 1956. Prior Council action (RES 13-19314) authorized consideration of the property's disposition.
The property was included in the City's 2026 property disposition review and received approval from the Property Disposition Committee and PRPL Board. Coldwell Banker marketed the property, resulting in three purchase and sale agreements. The highest offer is $834,800, exceeding the $825,000 listing price.
Required public notices were published in the Yellowstone County News on September 28, October 2, and October 9, 2026, with an onsite notice posted October 2, 2026.
The proposed sale follows the City's two-step disposition process, including public notice, public hearings, and Council approval. The transaction is contingent upon obtaining acceptable N2 zoning and applicable Urban Residential (UR) or Urban Residential Limited (URL) designation. The property in question, located in the Lampman Subdivision, is dedicated parkland known commonly as Lampman Park, geocode 03-0926-12-3-23-06-0000, as recorded on February 15, 1956, under Document No. 557995. This space is approximately 6.04 gross and net acres more or less. Prior Councilmembers approved the disposition of this parkland in RES 13-19314 (attached).
PRPL DIrector, Gavin Woltjer, presented to Council on March 2, 2026, a list of properties considered for disposal. Lampman Park was included in this list of properties. Additionally, the Property Disposition Committee and the PRPL Board both approved the disposition of Lampman Park.
Legal ads were published in the Yellowstone County News on September 28, October 2, and October 9, 2026.
Notice on the property was posted on October 2, 2026.

The proposed sale follows the City's established two-step disposition process:
1. Resolution of Intent — public notice (including onsite posting), public hearing, and Council determination that the property is no longer needed to conduct City business or that disposal serves the public interest.
Upon completion, the City will exit ownership of this property.
CONTINGENCIES:
1. N2 Zoning is approved
2. Area in question is mapped to either Urban Residential (UR) or Urban Residential Limited (URL)
3. Buyer may extend the Release Date for up to two (2) successive thirty (30) day periods by written notice to Seller before the then-current deadline.
4. Buyer shall engage with the zoning process as soon as available, once the Placetype map is updated.
5. If zoning is approved administratively, Buyer may accelerate Closing to ten (10) days after final approval.
6. If acceptable zoning is not obtained by the Release Date, as extended, Buyer may terminate and the Earnest Money shall be returned.
RELEASE DATE: 120 days from execution of 15 days after acceptable approval for said zoning.
