RECOMMENDATION
Staff recommends the City Council hold a public hearing and approve this ordinance on first reading, adding recently annexed property to Ward 5.
EXECUTIVE SUMMARY
On September 1st, 2026, IMEG Engineering, on behalf of John Mullen, requested an annexation or the 52-acre property is located south of Hesper Road and east of South 48th Street West, Tax ID: D00794A. This ward boundary ordinance is being done to include the recently annexed property into a City election ward.
BACKGROUND (Consistency with Adopted Plans and Policies, if applicable)
IMEG Consultants Corp., on behalf of John Mullen, submitted a petition to annex land using the provisions of Section 7-2-4600, MCA. The property is located south of Hesper Road and east of South 48th Street West. The land being annexed is described as being A parcel of land situated in the NW1/4, of Section 22, Township 1 South, Range 25 East. Yellowstone County, Montana, more particularly described as follows: That part of the NW1/4, of Section22, Township 1 South, Range 25 East, of the Principal Montana Meridian, Yellowstone County, Montana, described as Tract 1, of Certificate of Survey No. 3926, on file in the office of the Clerk and Recorder of said County, under Document No. 4108127, including all adjacent Rights-of-Way. Said annexation contains 52.00 Gross acres, and 49.89 Net acres, more or less.
Upon Council approval, this annexation requires a change in the boundaries of Ward 5. Two readings are required for this action. The first reading and public hearing is scheduled for this meeting. Upon Approval, the second reading will occur October 26th.

FISCAL EFFECTS
This application has no impact on the Planning Division Budget.

City Council may:
- Approve adding the subject property to Ward 5, or;
- Disapprove adding the subject property to Ward 5. Disapproval will not modify the boundary of Ward 5 and will create a problem where property inside the City Limits is not within a City Ward.
