RECOMMENDATION

Staff recommends that the City Council approve the Annexation Agreement with JMS Holding, LLC representing Parcel 1, Certificate of Survey Number 3926 located at the southeast corner of Hesper Road and 48th Street West.
 

EXECUTIVE SUMMARY

City Council will consider annexation of Parcel 1 of Certificate of Survey 3926 on October 12, 2026. The proposed Annexation Agreement requires the Developer to dedicate right-of-way, provide infrastructure and street improvements needed for development, fund traffic mitigation, and pay applicable system development fees. The annexation is not expected to have a significant financial impact on the City.

BACKGROUND (Consistency with Adopted Plans and Policies, if applicable)

At its October 12, 2026 meeting, City Council will consider the annexation of Parcel 1 of Certificate of Survey 3926. The proposed Annexation Agreement includes standard provisions requiring off-site improvements upon development and a waiver of the right to protest Special Improvement Districts.

The parcel is served by Hesper Road and South 48th Street West. As the parcel develops, the Developer will be required to extend water and sewer infrastructure, construct multi-use trails, and widen streets as needed to serve the development. The Agreement also requires dedication of public right-of-way along both roads to meet principal arterial street standards.

The Developer must fund traffic improvements identified in a traffic study and pay applicable system development fees at the time of development. Consistent with other recent annexation agreements, the Agreement also includes a warning and indemnification provision concerning the City of Billings Water Reservoir.

FISCAL EFFECTS

The parcel is served by the existing City street network and utilities, so the annexation is not expected to have a significant financial impact on the City. Upon development, the Developer will be responsible for extending streets and utilities as needed to serve the parcel, paying applicable system development fees, and funding traffic improvements identified in a Traffic Impact Study.

ALTERNATIVES

City Council may:
  • Approve the Annexation Agreement with the Developer; or
  • Not approve the Annexation Agreement.  If the agreement is not approved, Developer parcels will not be annexed and will not receive City services.
