PROBLEM/ISSUE STATEMENT
Bench Boulevard will be reconstructed from Lincoln Lane to the north side of Hilltop Road by the Montana Department of Transportation (MDT). The estimated start date for the construction of the project is late summer 2012. MDT is currently acquiring right of way from property owners along Bench Blvd. in the name of the City of Billings. As a result, MDT is asking the City of Billings to accept the deed for the new right of way from Michael McCafferty and Laura McCafferty at 710 Bench Blvd. This deed transfers ownership of 413 square feet of right of way from the property owner to the City of Billings. Additional warranty deeds for the reconstruction project will be presented for approval at future Council meetings.
ALTERNATIVES ANALYZED
The Council may:
- Accept the bargain and sale deed allowing the reconstruction of Bench Boulevard or:
- Do not accept the bargain and sale deed. If the right of way is not accepted, the MDT construction project would likely not proceed.
FINANCIAL IMPACT
There is no financial impact to the City. MDT is acquiring the right of way in the name of the City of Billings as part of the Bench Boulevard reconstruction project.
RECOMMENDATION
Staff recommends that the City Council accept the bargain and sale deed to allow reconstruction of Bench Boulevard by the Montana Department of Transportation.
